Recommendation: It is recommended that the City Council take the following action:
Approve the Resolution and ratify the complete copy of the Unit 6 2008-2010 Memorandum of Understanding,
on file in the City Clerk's Office, which incorporates the changes summarized in Attachment A.

Summary Statement:
Pursuant to the provisions of the Meyers-Millias-Brown Act, the representatives of the City of Petaluma and the
Peace Officers' Association of Petaluma met and conferred in good faith regarding wages, hours, and other terms
and conditions of employment. They jointly present to the City Council of the City of Petaluma, and recommend
approval of, the Memorandum of Understanding (MOU) for the period July 1, 2008 and ending June 30, 2010.
Summary of changes to the MOU are summarized in Attachment A. The complete copy of the 2008-2010 MOU
is available in the City Clerk's Office.

Resolution Ratifying Memorandum of Understanding Executed By the Duly Authorized
Representatives of the City and the Peace ®fficers' Association for Employees of Unit 6 (Police)
RECOMMENDATION: It is recommended that the City Council approve the attached Resolution, and
ratify the complete copy of the Unit 6 2008-2010 Memorandum of Understanding on file in the City
Clerk's Office which incorporates the changes summarized in Attachment A.
2. BACKGROUND: The Peace Officers' Association of Petaluma Memorandum of Understanding for
Unit 6 expired on June 30, 2008. The City met and conferred with union representatives and has
reached agreement with the Union over the terms and conditions of employment for the contract
period July 1, 2008 through .June 30, 2010.
FINANCIAL IMPACTS: The Unit 6- MOU (Police) has an existing provision in the MOU that requires
the City to provide a monthly benefit that is calculated by taking the cost of the monthly CaIPERS
Health Premium for Kaiser -Bay Area/Sacramento less the City's Public Employees' Medical and
Hospital Care Act (PEMHCA). The City's employer contribution for each PEMHCA contribution times
ninety-five percent (95%) for each employee and his or her family members (see chart below). The
employee pays the difference between the cost ofhis/her health plan premium and the City's contribution.

The Unit 6 MOU (Police) is on a fiscal year basis from July 1 to June 30. Ca1PERS health plan rate
increases are on a calendar year basis. The additional cost to the City of providing this benefit to
employees in Unit 6 for FY 2008/2009 was $86,813. The additional cost to the City of providing this
benefit to employees in Unit 6 for FY 2009/2010 is estimated to be $33,593. For a total cost of
$120,406. The benefit has already been paid for FY 2008/2009. The benefit for FY 2009/2010 is
budgeted.

RESOLUTION RATIFYING MEMORANDUM OF UNDERSTANDING
EXECUTED BY THE DULY AUTHORIZED REPRESENTATIVES
OF THE CITY AND THE PEACE OFFICERS' ASSOCIATION OF PETALUMA FOR
EMPLOYEES OF UNIT 6 (POLICE)
WHEREAS, the City, through its duly authorized representatives, and the Peace
Officers' Association of Petaluma, through its duly authorized representatives, have concluded
their mutual obligation to meet and confer in good faith with respect to terms and conditions of
employment for the employees in Unit 6, in accordance with the Meyers-Milias-Brown Act and
the City's Employer-Employee Relations, Rules, and Regulations (Resolution No. 5512 N.C.S.);
and,
WHEREAS, the duly authorized representatives of the City and the Peace Officers'
Association of Petaluma have executed a Memorandum of Understanding pursuant to Section
15, Resolution No. 5512 N.C.S. and recommend its approval by the City Council; and,
WHEREAS, the City Manager, pursuant to Section 28, City of Petaluma City Charter,
and as the City's Municipal Employees' Relations Officer (Resolution No. 5375 N.C.S.) is
required and empowered to make a recommendation to the City Council. on matters related to
employees' compensation; and,
WHEREAS, the City Manager has reviewed and concurs with said Memorandum of
Understanding for Unit 6 and does recommend that the City Council ratify said Memorandum of
Understanding.
NOW, THEREFORE, BE IT RESOLVED that the Memorandum of Understanding,
being in the best interests of the City, is ratified and the terms and conditions of said
Memorandum of Understanding shall be effective July 1, 2008 through June 30, 2010.

Benefits
1. Employee Contribution to Health Benefits
Employees shall contribute the Ca1PERS Health Premium amount for Kaiser -Bay
Area/Sacramento less one hundred dollars ($100) times five percent (5 %) for the employee
and his or~her family members.
2. Health Benefi s -Retires Employees
The City uses the "Unequal Contribution" method for health care premium payments for
annuitants (retirees), as permitted under Government Code Section 22892. Under this
method the City is required annually to increase the total monthly annuitant health care
contribution to equal an amount not less than the' number of years the City has been in the
PEMHCA program multiplied by five percent (5%) of the current monthly employer
contribution for active employees until the time the City's contribution for annuitants equals
the City's PEMHCA contribution for active employees.
3. ~ecial Compensation.-Traffic Officer
Provides certain amounts when assigned to trainpolice officer in the POST trainingblock
for traffic enforcement programs.
4. Special Compensation - Bilingual Pay- Spanish
Provided $200 per month for' certification at a high level proficiency or verbally fluent.
Provided $100 for acceptablelevel proficiency or conversational.
5. Compensatory Time -Request for Time
Employees wishing to use accrued compensatory time off shall make request in writing
to his or her supervisor.
6. Retiree Medical Expense:. and Health Trust
The Peace Officers' Association of Petaluma has elected to enter into an agreement with
the Peace officers Research Association of California (PORAC) Retiree Medical Trust in
order that employees in the Association may become participants in the trust plan.
