Adopt resolution. repealing.. and updating. enabling legislation for the Petaluma Youth Commission to add a Council Liaison; and adopt resolution appointing a Council'Liaison to the Petaluma Youth Commission for the calendar .year 2010. , BACKGROUND: The City Council. has expressed a,desire: to add a Council Liaison to the Youth Commission. The attached resolution repeals.and updates the enabling legislation for the Youth Commission to include a Council Liaison, to be appointed by'Council annually m January to serve `for that calendar year. In order to avoid having an even: number of voting members (tie: votes would result in no action being taken or recommended), the resolution also states that the Recreation„ Music, and Parks Commission (RMPC) representative to the Youth Commission is .to be a voting member of the Youth Commission. W~IEREAS, young peopleand their families benefit from improved knowledge of and access to services; and,. W>E°IEREAS, the Gity Council wished to cl'arify'the duties; authority; composition, voting, terms, vacancies, and criteria for removal for'all Ci"ty Boards, Commissions; and Committees. NOW, THEREFORE; BE I'~ I2ES,OLVED that: 1. Repeal. A11' previous resolutions relating, to the. City's Teen Council and Youth Commission ("Commi'ssion") are repealed and's.aperseded by this resolution to the extent that they contain provis-ons that, conflict with this res'ol`ution. 2. Merging. The' Teen Council is added to the Youth Commission, forming one Youth Commission. 3,. Continuance of Current~Terms ,Subjecf tg the tears of'th'is resolution, current members of the Youth C'ornmssion. shall continue. to serve for the :remainder of"the terms fo wh'ich they .have been appointed. 4. ~ Composition. Selectiorr'Process. InApril. of each year; notice. will be provided announcing upcoming openings, on the'. Commission (by means of networking, articles; flyers, advertising, and other means). During the month' of May; asub-committee of'the Commission wild review appl'catians and interview candidates. Recommendations will be conveyed. to the City Council who will conduct final approval of all Commission appointments. 6: 1Vlission. The purpose of the Commission is to be an advocate for the well-being and development of youth through the age of 2 T, in the City of'Petaluma in the five areas of their mission: health, safety;; recreation,. jobs, and community engagement. 7. Duties/Authority. The Corimmission'sduties shall include education, public.relations and fundraising relating-to issues of importance to youth in the Petaluma community, providing,advice to the CityCouricil regarding such matters; and such other duties as may be prescribed by ordinance, resolution; rule'. or direction of the City: Council. The Commission's duties do not include; oversight of the Petaluma staff or operations. The Commission has no authority to employ any person or.ncur any expense or obligation without the approval of the City Council. 'The commission .shall have the right to establish such procedures and. regulations as it deems appropriate far the conduct of its meetings, the selection of its officers and the performance of its functions, consistent with applicable law, including al'1 appl'icatile City ordinances, regulations, rules and/or direction of the City Council. Terms. The terms of office .of each, member, other than'the Recreation, Music, and Park Liaison shall be two years. The Recreation, Music, and,Park Liaison shall be appointed annually by the,Recreation, Music, and Park Commission to serve aone-year term from July 1 -June 30. The member"s' terms. shall be staggeredsuch that the terms of no more than ten members shall expire in any given year: Notwithstanding the expiration of a member's term pursuant to this provision, and subject to provision 8, members shall serve until a successor is appointed. by the City Council. 9. Resignation/ltemoval. The City Council. may declare; the office of a member vacant: upon the resignation, death, disability that results in .,the inability of a member to perform her/his duties; .loss of residency or other status .required:. for the. member to be eligible to serve; uriexcused absence of a merriber from three consecutive regular meetings of the Commission; or for any other reason in the Council's sole di"scretion, 10. Vacancies. Upon declaring a. Commission seat vacantfor any reason, the Commission will 'irnpl;emenf the selection :process -and the ,City Council shall. thereupon appoint a qualified person to fill the vacancy for the unexpired term. 11. Quorum/Action, A quorum of I 1 members is required to meet and conduct business. Fewer than 11 members or if no members are present, staff'to the Commission, may adjourn meeti-ngs of the Commission in accordance w h all applicable requirements of the Ralph M. Brown Act (California Government Code Section 54950 et seq.). A11 :actions or'recommendations of the Commission shall he made at a meeting at which a quorum of the Commission is present and shall be made by majority vote of the members .present. A tie vote shall constitute no action on the motion, proposed .action or recommendation. .1. 12. Staff. The'City's Parks and Recreation.Department shall advise and support the Commission as appropriate in the performance ,of its duties. COUNCIL LIAdSON AS A VOTING MEIVIBER OF THE PETALUIVIA YOUTH ~COIVIMISSION AND 'I~PEA;LING AND=JPDATIN'G ENABLING LEGISLATION FOR THE PETALUIVIA YOUTH COMMISSION W>[IEREAS, the City~Council created the Youth Commission by resolution in 1999 by Council Resolution 99-204 N:C.S.; and, WHEREAS; the City Council repealed and updated the enabling legislation in 2008 by Resolution 2008"-226 N'.C.S:; and, WHEREAS, the Cit-y Council has .expressed a:desre to formally add a member of the City Council as a Council liaison and voting member of.the Commission. NOW, THEREFORE, BE IT RESOLVED that:- l . Repeal. All previous resolutions relating to the City's Youth Commission (`.`Commission") are repealed and superseded 6y this resolution to the extent "that' .they contain provisions that conflict with this resolution. 2. Continuance of Current Terms: Subject~to the terms of this resolution, current members of the Youth Commission shall continue to serve for the remainder. of the terms to which they have been appointed. 3. Composition. The Commission shall consist of twenty-three members, as follows: ® Seven adults ,(ages 21 or older), and fourteen"youth (eighth .grade through age 20) shall be appointed by Council from the community at large. -Members shall -live. within the local school district boundaries. ® One member of the Recreation, Music, and Parks Commission (RMPC); selected' by the RMPC; wli"o shall serve" as liaison between the- Youth Commission and the RMPC, and who shall be a voting member of the Commission. ® One member' ofthe City Council; seleeted by the City Council, who shall serve as liaison between the Commission and' fhe City Council; and who shall `be a voting member of the Commission. 4.
