RES:OLU-TION APPROVTNG ISSUANCE OF A MITIGATED NEGATIVE
DECLARATION PURSUANT TO CEQA FOR THE CREATION OF THE
AARON ACRES SUBDIVISION LOCATED AT 1003 WESTERN AVENUE
(A.P.N. 019-110-.3'4)
WHEREAS, the Planning Commission has recommended issuance o.f a Mitigated
Negative Declaration p:ursiiant to .the California; Environmental Quality Act
(CEQA) for a proposal to' create a 12 lot residential subdivision, at 1003
Western Avenue; and
WHEREAS, an initial study which noted traffic, drainage, grading and
erosion, biotic and visual .impacts has b8err prepared for the' area and has
been reviewed by the Gomrnunity Development and Planning Department; and
WHEREAS, focused studies have been prepared to address specific concerns
in the areas of geotechnical and biotic impacts; and
WHEREAS, the results of these studies has indicated that approval of this
project as conditionally approved will not trigger any significant adverse
environmental impacts; and,
WHEREAS, staff and the Planning Commission have recommended that a
mitigated. negative declaration be issued on the above project;
NOW, THEREFORE, BE IT RESOLVED that the issuance of said Negative
Declaration pursuant to the California Environmental Quality Act is hereby
approved;'based upon the following findings:
1. The prgj"ect as conditionally approved does not have the potential to
.degrade. the quality of the environment,. to substantially reduce the
habitat of a fish or wildlife species, cause a fish or wildlife population

to drop below self sustaining levels, threaten to eliminate a plant or
animal community, reduce the number or restrict the range of a rare
or endangered plant- or animal, or eliminate important examples of major
'periods of California history or prehisto"ry.
2. There is no significant vegetation slated for removal as part of this
project ..
3. The project as .conditionally approved does not have the potential to
achieve short-term to the disadvantage of long-term environmental
goals .
4. The project as conditionally approved does not have impacts which are
individually limited but cumulatively considerable.
5. The project as conditionally approved does .not have environmental
effects which will cause substantial adverse effects on human beings
either directly or indirectly.
6. Traffic from the project will be limited because of the limited number
of home sites available.
7. The geotechnical impacts will be adequately addressed through the
preparation of additional investigative report preparation prior to
consideration of the t~n~~ive final map by the City Council; and
;additional geotechnical analysis and incorporation of recommendations
into proposed development design will be completed on a lot by lot
basis prior to submission of SPARC review package.

8. Identified impacts relative to view preservation and privacy protection
will be mitigated to acceptable levels by the completion of a perimeter
fence concurrently with construction of subdivision public
improvements, increasing of rear yard setbacks, and preparation of
general design guidelines.
9. Traffic and utility system impacts will be adequately addressed by the
completion of on and off-site improvements as required by the City
Engineer.
