HomeMy WebLinkAboutResolutions 87-344 N.C.S. 12/07/1987?~ Resolufion No. R~-~~~ N, C~~. of the City of Petaluma, California RESOLUTION APPROVING ISSUANCE OF A MITIGATED..N,EGATIVE DECLARATION PUR'SU'ANT TO CEQA FOR AN, AMENDMENT TO T.HE CREEKVIEW COMMONS P,LAN.NED UNIT DEVELOPMENT LOCATED AT ELY BOULEVARD NORTH AND MONROE STREET (AP NO. 1'36-111-19) WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative Declaration pursuant to the California Environmental Quality Act "(CE.QA) for a proposal to -incorporate a half-acre parcel into the existing Creekview Commons Planned Unit Development; and WHEREAS, an initial study. .which noted potential :traffic, noise, and visual iinp.acts has. been prepared for the area and has been reviewed by the Community Development and Planning Department; and WHEREAS, . the results of this study have indicated that approval of this project ,as conditionally approved will not trigger any significant adverse environmental impacts; and, WHEREAS, the Community Development and Planning Department and the .Planning Commission have recommended that a .mitigated negative declaration be issued on the above project,; NOW, THEREFORE, BE :IT RESOLVED that the issuance of said Mitigated Negative Declaration pursuant to the California Environmental Quality Act is hereby ~ag,proved, based upon the following findings: a. Due to the developed nature of the existing site, the project does not have the potential to degrade the quality of the environment, substantially reduce the habitat: of a fish or wildlife species, cause fish or wi d-life population to drop below self-sustaining levels, threaten to eliminate a; plant or animal community, re.du,ce the number or restrict th,e range of, a rare or endangered plant or animal or eliminate important .examples of major periods of` California history or prehistory. 1 RESO. 87-344 N.CS b . The project as conditionally approved does not have the potential to achieve short term to the disadvantage of long term environmental goals . c. Because the project does not include additional phased development, the project as conditionally approved does not have impacts which are individually limited but cumulatively considerable. d. The project as conditionally approved does not have environmental effects which will cause substantial adverse effects on human beings either directly or .indirectly. e. The project as approved, includes conditions intended to mitigate identified impacts including - Extension of soundwall along Ely Blvd. and sound reduction measures in construction of the new buildings to provide sound reduction . - SPARC review to insure architectural and landscape compatibility with the surrounding development. - Major Facilities Traffic Mitigation Fee. reso, creekview. pud/reso8 Under the power and authority conferred upon this Council by the Charter of said City.
