RESOLUTION DENYING APPEAL AND MODIFYING
CONDITIONS OF PLANNING COMMISSION .APPROVAL OF
CONDITIONAL USE PERMIT FOR RICKARD
ACCESSORY DWELLING
WHEREAS, Christine M. Rickard requested approval of a conditional
use permit to allow conversion of an existing accessory building to an
accessory dwelling, at 717 A9ountain View Avenue, Sonoma County
Assessor's Parcel No. 008-454-52; and,
WHEREAS, the Planning Commission considered the application during a
public hearing on August 11, 1987, at which time the conditional use permit
was granted based on specific findings and subject to certain conditions;
and,
WHEREAS, the applicant appealed. this decision in accordance with
applicable provisions of the Zoning Ordinance; and,
WHEREAS, the appeal was considered by the City Council on
September 21, 1987, during which time public testimony was heard and
considered prior to the Council rendering its decision;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence
presented by staff and the recommendation of the Planning Commission, the
City Council of the City of Petaluma hereby adopts the following findings:
1. The proposed use, subject to the following conditions
' will eon,forrn to the intent of the Zoning Ordinance and the
policies of the General Plan/EDP.
2.. The proposed use, subject to ,.the following conditions will
not constitute a nuisance or be detrimental to the public
welfare of the community.
NOW, THEREFORE, BE IT ALSO RESOLVED that the City Council of
the City of Petaluma denies the appeal of Christine M. Rickard thereby
upholding the Planning Commission's decision.

NOW, THEREFORE, BE IT FURTHER .RESOLVED that the City Council
hereby modifiesd the conditions of approval, as follows
I. The accessory dwelling shall be subject to review by the
Site Plan and Architectural Review Committee (SPARC) before
issuance of a building permit (per Zoning Ordinance Section
26-401).
2. A private fenced outdoor yard area shall be provided for the
accessory dwelling unit subject to SPARC approval.
3. The sealed garage door opening in the northern wall of the
proposed accessory dwelling shall be .removed and replaced with
appropriate wall material subject to approval of SPARC and
the City Building Inspection Department.
4. Cracked or uneven areas of the public sidewalk in front of the
property shall be replaced or repaired subject to approval
by the City Engineer.
5. Fencing with missing or broken boards shall be replaced with
new material matching the type and color of the existing fence
prior to issuance of the certificate of occupancy.
6. Broken and undersized windows shall be replaced with new
windows providing window area as required by the U.B.C.,
subject to approval of Chief Building Inspector.
7. Gas and electric meters separate. from the principal dwelling
shall be provided for the accessory dwelling.
8. This project is subject to the following fees (for the
applicants information only)
a. School Facilities
b. Sewer Connection
c. Dwelling Construction
9. Applicant to work with City staff and neighbors to identify
and eliminate drainage problem.

NOW, THEREFORE, BE IT ALSO RESOLVED that it is the direction of
the City Council per majority consensus that elimination of the minor local
drainage situation is to be shared and participated in by the neighbors of
the Rickard property, as well as other affected property owners in the
vicinity; and, that if cooperation is not achieved after a good faith effort
by applicant, the condition may, at staff's discretion, not be enforced.

I hereby certify the foregoing Resolution was introduced and adopted by the
