S. of the City of Petaluma; California RESOLUTION DENYING APPEAL OF PLANNING COMMISSION DENIAL bF REDWOOD PLAZA SHOPPING CENTER WHEREAS, Olga Lucas requested approval of a use permit to allow 13,000 sq.ft:. of shopping center buildings plus a fast food restaurant, to be called Redwood Plaza., located on 1.6 vacant acres at 5310 Old Redwood Highway, Sonoma County Assessor's Parcel No. 137-010-79; and WHEREAS, the Planning Commission considered this application during public hearings on March 24, April 14 and. May 12, 1987, at which time the application was denied due to placement of the fast food restaurant near Old Redwood Highway which was inappropriate in terms of traffic circulation and creating a strip commercial effect along this road; and WHEREAS, the applicant appealed this decision in accordance with applicable provisions of the Zoning Ordinance; and WHEREAS, the appeal was considered by the :City Council on June 29, 1987, during which time public testimony both written and verbal prior to the Council rendering its decision; NOW, THEREFORE, BE IT RESOLVED that based on the evidence :presented and the recommendation of~ the Planning Commission, the City Council. of the City of Petaluma hereby adopts the following findings: 1. The proposal did ~ not provide for satisfactory. location of the fast food pad site, nor development compatibility with adjacenf par.ceis. 2. The project as proposed has potential adverse effects that are cumulatively considerable because of the "strip commercial" nature of the project design and the. resultant traffic and aesthetic problems it entails, particularly from the location of the fast food restaurant. 3. The proposed site design was considered pursuant to Zoning Ordinance Section. 21-300 and was found to be detrimental to the community's health and welfare with regard to siting of the fast food restaurant building, relation of buildings with regard to adjoining uses, the activity level in relation to existing adjacent uses, and the creation of an apparent strip commercial area along two busy thoroughfares rather than an integrated shopping center. 4. Mitigation measures suggested by the Planning Commission were not adequately incorporated into the site design. NOW, THEREFORE, BE IT ALSO RESOLVED that the City Council of the City of Petaluma denies, without prejudice, the appeal of Olga Lucas, thereby upholding the Planning Commission's decision. NOW, THEREFORE, BE IT FURTHER RESOLVED that it is the direction of the City Council per majority consensus that if a use permit is granted for a shopping center and fast food restaurant on the subject parcel pursuant to subsequent application that: 1. the fast food restaurant be located away from Old Redwood Highway in the rear half of the site, 2. the amount of on-site parking be adequate for all proposed uses, and 3. the design of the proposed median island in Old Redwood Highway be reviewed by the City Engineer who shall consider all future development in the area when approving its design. reso.redwood.plaza RES07 Under the power and authority conferred upon this Council by the Charter of said City.
