A RESOLUTION':MAKING DETERMINATIONS,, DESCRIBING
EXTERIOR BOUNDARIES OF'TERRITORY DESIGNATED AS
ANNEXATION N0. 3 AND ORDERING ANNEXATION OF TERRITIORY TO THE
CASA DEL ORO LANDSCAPING ASSESSMENT DISTRICT-AND AUTHORIZING
THE LEVY AND COLLECTION OF ASSESSMENTS THEREIN PURSUANT TO THE
` LANDSCAPING AND LIGHTING ACT OF 1972
WHEREAS,-ori December 16, 1985, the Council adopted its
Resolution No. 85-392:'N.C,S. ordering the formation of the Casa Del
Oro 'Landscaping Assessment District pursuant to the Landscaping and
Lighting Act of 1972 .(.commencing with Section 22500) of the Streets
and Highways Code of the State of California;
WHEREAS, o,• ~ ,_.19.87., a Petition and
Consent for Annexation f' ritory to the Casa Del Oro Landscaping
Assessment District d.t the Levy and Collection of Assessments
Therein Pursuant to the Landscaping and Lighting Act of 1972 signed
by all of the owners of land as shown on the last equalized county
assessment roll or entialed to be shown as owners. on the next county
assessment roll or where any of said property is subject to a
recorded written .agreement of sale, are shown therein as purchaser,
of all of the territory more particularly hereinafter described, was
filed with the City Glerk.of said City, pursuant to the Landscaping
and Lighting Act of 1972, Division 15, Part 2 commencing with
Section 22500) of the: Streets and Highways Code of the State of
California and especially Section 22608.1 thereof;
WHEREAS, said .Petition and Consent consented to said
Council's conduct of said proceedings without notice and hearing and
without the filing of an Engineer's Report, all in accordance with
said Act and. especially said Section 22608.1 thereof'; and
WHEREAS, proof satisfactory to. this Council of such
consent by all of said owners of property within said territory has
been filed with the Clerk of this City:
BE IT RESOLVED'by the Council of the. City of Petaluma,
County of'Sonoma; as follows:

1. Said Petition and Consent for the Annexation of
Ter:r;itory to the Casa Del Oro Landscaping-Assessment District and to
the Levy .and Collection of Assessments Therein Pursuant to the
Landscaping and Lighting A'ct of 1.972., without notice and hearing and
without. thefling of an Engineer's Report was signed by all of the
owners of land as shown on the 'last equalized .county assessment roll
or entitled to be showm as owners on the next county •assessment roll
or. where any of said property is'~ "subject to a recorded written

agreement. of sa~le,~are shown therein as purchaser and .this Council
has ac.qur;ed jurisdiction to o"rder the annexation of''aaid territory
to the Casa Del Oro Landscaping Assessment District:
2. The -description of the. exterior boundaries of the
territory proposed to be annexed to said Casa Del_ Oro Landscaping
Assessment District is more particularly set forth in Exhibit "A"
hereto attached and by reference incorporated 'herein.
3. The annexation of said territory to said Casa Del Oro
Landscaping Assessment District and the authority of this Council to
levy and ,collect assessments 'therein pursuant t:o-said Act is hereby
approved without notice and hearing and without the. filing of an
Engineer's Report pursuant to Section 22608.1 of said Act.
4. Said territory be, and it is hereby, ordered annexed
to said Casa Del .Oro Landscaping Assessment District for the
installation or construction of improvements and the maintenance or
servicing, or both thereof together with any and all incidental
expenses in connection therewith, all as more particularly
authorized pursuant to said.. Act.
5. Proceedings shall. be taken by this Council pursuant to
said Act for the 'fiscal year during which an assessment is to be
levied and collected within said District.
6.' 'The Clerk of.this City be, and is, hereby, authorized
and.,.directed to file a certified copy of this resolution together
with a map~of said territory with the County Auditor of Sonoma
County:

Being a portion of the lands of LEONARD JAY DEVELOPMENT
ENTERPRISES, a partnership, as said lands are describe by
Dee recor ed under Document 85075553 of Official Records,
Sonoma County Records, more particularly described as:
Beginning at the common southerly corner of said lands of
Cypress Hill and Parcel No. 2 as shown on Petaluma Parcel
Map No. 181, recorded in Book 331 of Maps at page 50, Sonoma
County Records, said point being the TRUE POINT OF BEGINNING;
thence along the common boundary of said. lands of Cypress Hill
and said Parcel 2, North 2°38'12"West 708.21 feet to the common
northerly corner of said lands of Cypress Hill and said Parcel
2; thence leaving said common boundary and along the northerly
boundary of said lands of Cypress Hill, North 74°23'55" West
412.15 feet to the northwesterly cornea of said lands of Cypress
Hill; thence along the westerly boundary of said lands of
Cypress Hill, South 14°52'39" West 230.33 feet to a corner;
thence leaving said boundary of Cypress Hill, South 16°48'39"
West 379.70 feet to a point on the southerly boundary of said
lands of Cypress Hill; thence along the southerly boundary
