RESOLUTION OF INTEPITION
TO APPROVE AN AMENDMENT TO CONTRACT
BETWEEN THE
BOARD OF ADMINISTRATION
OF THE
PUBLIC EMPLOYEES' RETIREMENT SYSTEM
AND THE
CI TY COU NCIL
OF THE
CITY OF PET ALUMA
WHEREAS, the Public Employees' Retirement Law permits the participation of
public agencies and their employees in the Public Employees
Retirement System by the execution of a contract, and sets forth
the procedure b.y which said public agencies may elect to subject
themselves and their employees to amendments to said Law; and
WHEREAS, one of the steps in the procedure to amend this contract is the
adoption by the governing body of the public agency of a resolution
giving notice of its intention to approve an amendment to said
contract, which resolution shall contain a summary of the change
proposed in said contract; and
41HEREAS, the following is a statement of the proposed change:
To provide 2~ @ 50 r-ull formula (from 1/2 @ 55 Full
formula and 2~ @ 55 Full formula) for local safety
members.
NOW, THEREFORE, BE IT .:RESOLVED that the governing body of the above agency
does hereby give notice of intention to approve an amendment to
the contr.aet between the said governing body and the Board of
Administration of the Public Employees' Retirement System, a copy
of said amendment being attached hereto, as an "Exhibit" and by
this reference made a part hereof-.

Thee. Board of Administratorn, Public Employees' Retirement System, hereinafter
referred to as, Board, and the governing body of above public agency, herein-
after referred to as Public Agency, having entered into a contract effective
January 1, 1.950, and witnessed October 18, 1849, and as amended effective
August 1, 1,959, November 1, 1959, March 1, 196:5, June 1, 1965, April 1, 19b9,
January 1, 1974, November"1-, 1,980, November 1, 19$1, July 1, 1882, and January
1, 1987, which provides for participation of Public Agency in said System,
Board and Public Agency hereby agree as followst
A. Paragraphs 1 through 12 are hereby stricken from Said contract as executed
effective January ~1, 1987, and hereby replaced by the following paragraphs
numbered 1 through 11 inclusive:
1. All words .and terms used herein which are defined in the Public
Employees' Retirement Law shall have the meaning as defined therein
unless otherwise specifically provided... "Normal retirement age"
shall mean age 60 for local miscellaneous members.,-and age 50 for local
safety members.
2. Public Agency shall participate in the Public Employees Retirement
System from and afte"r January 1., 1950 making its employees as
hereinafter provided, members o,f said System subject to all provisions
of the Public Employees' Retirement Law except such as apply only on
election. of a contracting agency and are not provided for herein and
to,~ aTl amendments to said Law hereafter enacted except those, which by
expres's provisions thereof, apply only on 'the election of a contract-
ing agency.
3. Employees of Public Agency in the following classes. shall become
members of said Retirement System except such in each. such class as
are excluded' by law or this agreement:
a. 'Local. Fire Fighters (herein referred to as local safety members);
b. Local Police Officers (herein referred to as local safety
membersj;
c. Employees other than local safety members (herein referred to as
loc'a1 miscellaneous members).

4!• In addition to the classes of employees excluded -from membership by
said. Ret°irement Law, the following classes of employees shall not
:become members of said Retirement System.:
ADDITIONAL EXCLUSIONS
5, The fraction of'fhal compensation to be provided for each year of
credited pr':or and current service as a local miscellaneous member
shall be determined in accordance with Section .21251.13 of said
Retirement Law (2~ at age 60 Full).
6. The fraction of final e:ompensaton to be provided for each year of
credited prior and current service as a local safety member shall be
determined in .accordance with Section 21252..01 of said Retirement Law
(2~ at age 50 Full).
7. The following add tional prgvsohs of the Public Employees'
Retirement Law, which apply only upoh elect•ion.of a contracting
agency, shall apply to the Pub13c Agency and its employees:
a. Sections 21:38'0 - .2`1387 ( 1959 Survivor Benefits) excluding Sect"ion
213$2.2 {Increased 1959 Survivor Benefit°s) and Section 21382.4
CThird Level of 159 S.urv`vor Benefits').
b. Section. 21222:1 (Special 5~ Incr;ease - 1.970). Legislation
repealed said Section effective January 1, 1980.
c. Section 20024.2 (.One-Year Final C.ompensation).
d. Section .20862.8 (Uhused Sick :Leave Credit).
e. Sect'ion•21223 (Special Ines-ease) for or on behalf of those local
•miscellaneous members who retired or died' prior to January 1,
1975:.
f. Sect.ions,2.1263„ 24263.1 ahd '2.1263.3 (.Post-Retirement Survivor
Allowance) .for local fire member-s only.
$. _ Pubaic.:Agency, in accordance.wit`h Government Code Section :20.740,
ceased to 'be an !'employer" for purposes of Section 20759 effective on
November 1, 1:980. Accumulated contributions of Public Agency shall be
fixed and~determned as provided in Government Code Section 20759, and
aceumulated,eontrbu,tions thereafter shall be held by the Board as
pro~'ided in Government Code Section 20759. •

9. Public Agency shall contribute to said Retirement System as follows:
a. With respect to local miscellaneous members, the agency shall
contribute the following percentages of salaries earned as
members of said Retirement Systems
(1) 0.0;02 percent until June 30:, 200,0 on account of the
liability for prior service benefits. (Subject to annual
change.)
(2) 7.969 percent until June 30, 2000 on account of the
liability for current, service benefits. (Subject to annual
change.)
(3) O.q&7~percent until June 30, 200.0 on account of the
liability for the 1959 Survivor Program.
b. With respect to local safety members, the agency shall
contribute the following percentages of salaries earned as
members of said Retirement„ System;
(1) 0.133 percent until. June 30, 1989 on. account of 'the
liability for prior service benefits. (Subject to annual
change..)
(2j 14.543 percent until June 30, 2-0OO on account of the
liabl"ty for current service benefits. (Subject to annual
change.)
(3) 0.105 percent until .June 30, 2'000 on account of the
liability for the 1959.Survivor Program. (Subject to annual
change.)
c. A reasonable amount, as fixed by the Board, payable in one in-
stallment within 60 days of date of contract to cover the costs
of adm.n_i tering said System as it affects the employees of
Pub c.Agency, not including. the costs of special valuations or
of the. periodic investigation and valuations required by law.
d. A reasonable amount, as fixed by the Board, payable in one in-
stallineht as, the occasions arise.., to cover the: costs of special
wal.uatons on account of employees of Public Agency, and costs of
the periodic investigation and valuations required by law.
10. Gon.tribut~ons required of Public Agency and its employees shall .be
subject to adjustment by Board on .account of amendments to the Public
Empl.oyees~ Retirement Law, and on account of the experience under the
Retirement System as determined by fhe periodic investigation and
valuation required by said Retirement Law.
11. Contributions required of Public Agency and its employees shall be
paid by Puble Agency to the Retirement System within thirty days
after the end of the period to which said contributions refer or as
may be prescribed by Board regulation.. If more or less than the
correct amount of contributions is paid for any period, proper
adjustment shall b:e made in connection with subsequent remittances.
Adjustments on account of errors in contributions required of any
employee may be made by direct payments between the employee and the
Board.
B. This amendment shall be effective on the
