HomeMy WebLinkAboutResolutions 87-234-5 N.C.S. 08/03/1987 resolution No. ~,_~N.C.S. ~~~y, ~'= of the City of Petaluma, California A RESOLUTION REGARDING APPEAL OF CERTAIN PLANNING COMMISSION CONDITIONS OF THE USE PERMIT FOR U-HAUL TRUCK, R.V. , AND EQUIPMENT RENTAL AND SERVICE CENTER TO BE LOCATED AT THE CORNER OF LAKEVILLE HIGHWAY AND PETROLEUM AVENUE ASSESSORS PARCEL NO. 005-050-05, 20, AND 21 WHEREAS on May 27, 1987 the Planning Commission held a public hearing and thereafter approved a conditional use permit for said U-Haul Rental Center; and, WHEREAS on July 1, 1987 George K. Hynek filed on behalf of U-Haul an appeal to the City Council from certain conditions of said conditional use permit; and, WHEREAS the City Council considered said appeal at their meeting of July 6, 1987. NOW, THEREFORE, BE IT RESOLVED that the appeal of Condition No. 1 with regard to front setback be granted with the requirement that the front setback plus the landscaped portion of the public right-of-way shall result in a total of at least fifty feet of planted landscaping between Lakeville Highway and the parking areas and at least twenty-five feet of planted landscaping between Lakeville Highway and the edge of the three approved display areas as shown on the site plan reviewed and approved with the use permit by the Planning Commission. BE IT FURTHER RESOLVED that the appeal of Condition No. 7 requiring U-Haul to bear the cost of right-of-way acquisition as needed for street improvements in front of the small properties on Petroleum Avenue is denied. 4 - k~y. vo...........-..~.........5. ~.cs. -. :~ BE IT FURTHER RESOLVED that with regard to the appeal of Condition No. 8 with regard to pay-back agreements for required frontage improvements for the three parcels surrounded by the project site on Petroleum Avenue that the applicant may prepare and file pay-back agreement with respect to said improvements. BE IT FURTHER RESOLVED that an additional condition be added to the conditions attached to the use permit for the afore-mentioned U-Haul Center which condition shall read as follows: "This project shall enter into an agreement assuring its participation in an assessment district for required public improvements to Lakeville Highway and shall agree to pay its fair share of said improvements. The form of said agreement shall be subject to approval of City staff . " BE IT FURTHER RESOLVED that Condition No. 27 be revised to read as follows: "Applicants shall participate in any future Assessment Districts or other funding mechanisms formed to improve area-wide flooding, traffic congestion or other sub-regional programs for which development of this property is found to be a contributing factor. Major Capital Facilities Fees, if found to be different from said funding mechanism, shall also be applicable in an amount to be determined by the City Council payable pursuant to adopted regulation. BE IT FURTHER RESOLVED that all other conditions of the afore-mentioned conditional use permit for U-Haul are hereby reaffirmed and remain in force. Under the power and authority conferred upon this Council by the Charter of said City.
