DENYING APPEAL BY HAROLD METCALFE
REGARDING USE PERMIT FOR A MACHINE SHOP
AT 501 2ND STREET, AP NO. 8-192-01
WHEREAS , an application for a use permit to allow a machine shop was filed
with the City in March, 198? by Harold Metcalfe of Metcalfe Machine Shop
and Engine Supply; and
WHEREAS, on May 12, 1987 the Planning Commission denied this application
after a duly publicized public hearing during which they considered all
pertinent data and testimony both written and verbal prior to rendering
their decision on this matter; and
WHEREAS, the applicant filed a letter of appeal on May 22, 1987; and
WHEREAS, the City Council considered this matter, including pertinent
information presented at the Commission hearing, written information, and
public testimony from the applicant and all interested persons who spoke on
this matter at their regularly scheduled meeting on June 15, 1987;
NOW THEREFORE BE IT RESOLVED, that the City Council makes the
following findings:
l. The following considerations governing conditional uses (Zoning
Ordinance Section 21-300) exist in regard to the project:

a. Due to the substandard width of the lot, the site is
inadequate to accommodate the proposed use, building and
related activities.
b. The relation of the proposed buildin.g height to an adjoining
building hinders outlook, liglit, and air.
c. The use in this location cannot be considered a matter of
public convenience and necessity.
2. T.he proposed use is not consistent with following policies and
programs of the General Plan :
a. Protect residential areas from commercial encroachment (from
1985 plan) .
b. Provide sound buffers, especially landscaped buffers, or
sufficient open space, between residential areas and areas
producing high sound levels, such as freeways, commercial
sites and industrial developments (from 1985 plan) .

structures, taking into consideration height, bulk and style
(from 1985, p~lan) . . ~
. d: Define 'a"nd. ` separat.e new , neighborhoods (and existing
neighborhoods, where feasible) by identifiable boundaries
(from 1987 plan) .
e. Facilitate compatibility between neighboring developments
(from 1987 plan) .
3. Therefore, the proposed use will not conform to the intent of the
policies of the General Plan . The proposed use will not conform
to the zoning ordinance in it.s intent to be in harmony with the
`Petaluma General Plan (Section. 1-202) ..
4. T,he, ;proposed use may constitute a nuisance and be detrimental to
the publ'ic welfare of the community.

NOW, THEREFOR~, BE IT RESOLVED that the City Council hereby denies
the appeal of the Planning Commission decision on this matter and upholds
the Planning Commission decision to deny this application for a use permit
to allow a machine shop at 501 2nd Street, G Street between lst and 2nd
5treets.
