RESOLUTION AUTHORIZING. THE PAYMENT BY 1'HE
CITY OF PETALUMA OF THE DIFFERENCE BETWEEN
THE ASSESSMENT LEVIED IN ASSESSMENT DISTRICT
NO 6 N. S. BETWEEN THE ACTUAL ACREAGE .OWNED
AND ACREAGE ASSESSED AND DIRECTING THESE
COSTS BE PAID OUT OF THE 1953 SANITARY SEWER
SYSTEM CONSTRUCTION FUND.

WHEREAS, at the.public hearingkheld'. at 8:0i8 p. m. , July 23, 1962, on
Assessment District No 6;N. S. it appeared that certain property owners were
assessed for acreage which they did not own; and
WHEREAS, the. Council by !motion duly adopted declared that it vvould
pay the difference between actual acreage.and assessed acreage;. and.
WHEREAS,, it appears. that.Philip Joerger, a property owner within
the Assessment District, was assessed for acreage in excess of actual ownership
and that his original assessment was $33,,448. 91; and
WHEREAS, Phillip Joerger has furnished'' evidence to the satisfaction
of the City. Engineer and City Attorney that his actual.acreage ownership is not as
per assessed acreage ownership; and
WHEREAS, the reduction in acreage reduces, pursuant to the City's
-motion hereinabove referred.to; Mr. Joerger's obligation to pay to 527, 759. 05 and
requires the City to contribute,b55', 289. 86
NOW, THEREFORE, BE IT RESOLVED that the City Clerk and Auditor;
be, and she is, hereby authorized to execute a warrant or check. in the amount of
1$5, 289. 86 for the purposesiof contributing this amount to the assessments levied on
'property owned by Mr. Philip Joerger in proportion to the reduction in acreage in
order that he pay the appropriate amount:bn each assessment levied as against his land;'
BE IT FURTHER RESOLVED that this City',s contribution be charged
to the 1953' Sanitary Sewer System Construction.Fund.
