RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PETALUMA REQUESTING THE BOAR . 'OF SUPERVISORS
OF SONOMA COUNTY TO PROVIDE FOR THE CONSOLI-
DATION OF A SPECIAL MVIPUNICIPAL ELECTION WITH
THE SPECIAL CONGRESSIONAL ELECTION OF THE
FIRST CONGRESSIONAL D[STRICT OF 7-HE STATE OF

WHEREAS, the City Council of the City of Petaluma has duly adopted
a resolution calling a special municipal election in the c",ity of Petaluma, at which
there will be submitted to the qualified electors of said City voting thereon a1 measure
for amending Article XI, Section of of the City Charter of the City of Petaluma; and
WHEREAS, ;a specilal election calked by the Honorable Edmund C. Brown,
• Governor of the State of California; will be held on January 22, 1963; and
WHEREAS, the Board of Supervisors of the County of Sonoma;may call
a special bond election for January 22, 1963 and it is the desire of the City Council
that the special. municipal election,for the(City of Petaluma be consolidated with which'
ever special election held on.January .22, 1963 is .considered. appropriate by the Board

of Supervisors of the County of Sonoma;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City

of Petaluma, as follows:
Section 1. A special municipal election is hereby called to be held in
the City of Petaluma on TUESDAY, JANUARY 22, 1963, at,which election shall be.

submitted to the qualified electorspof said•;City the following measure, to wit:!

MEASURE SUBMITTED TO VOTE OF VOTERS,
MEASURE: Shall Article XI, Section 75•of the City Charter of the
City of Petaluma be amended to read as follows:
"The Council.,may by ordinance provide a,procedure,for 'the :
granting of franchises, or leases or grant franchises pursuant: to the : •
procedure provided by the i'srate law, Franchises or leases may be : •
granted for the use of the streets, public places or=property of the : YES
City upon such'terms, conditions. `restrictions and limitations as
may be prescribed by ordinance, but no franchise or Tease shall be
granted without reserving' to the City adequate compensation for the •
privilege conferred.. Franchises or leases may be granted for a
period of 50 years with the option to renew for an additional 25 years;
No franchises or leases shall be granted for longer period than
herein, specified except that franchises or leases graited to a public : NO :
utility may be granted for a longer period provided there is reserved
to the City the right to take.o-ver at any time r_he portion of such utility : •
located within the City without compensation for the value of franchise
or lease granted," •
Section 2. The Board of Supervisors of Sonoma Coui"ity is hereby requested
to order the consolidation of said special. .°I unicipal election with the SpecialiElect:ion to
be held on'TUESDAY, JANUARY 22, 1963' insofar as the City of Petaluma is concerned,
and to further provide that within the terri.Itory affected by said order of consolidation

in.every case be the same, and there shalll he only one set of election officers in each of
said precincts, Said measure of amending Arni le XI , Section 75 of the City l Charter of
the City of Petaluma shall be set forth in each form of ballot to be used at said, election
insofar as the same is held within 'said City of Petaluma,. including Nonpartisan ballots&
In the event no Nonpartisan ballots are provided by said Board of Supervisors for use
within, said City of Petaluma, then ,a separate ballot setting.forth said measure shall
be made available for use at said election within said City of Petaluma, to the end that
all qualified electors within said City, irrespective of their party registration, shall
be entitled, to vote at said 'consolidated election on the measure of amending Article XI,'

ed to. cause to be printed upon., the ballots to be used at said consolidated spe lial municipal
election and the State.of California: Special.IEl:ection for the First Congressio Ial. District,
within. the City iof Petaluma,. said City of Petaluma treasure in the form set,forth in Section
I of this resolution&

Section• 4, Said Board of SupervisdrsofSonoma.County is hereby further
authorized to canvass the returns of said election with, respect to said City of Petaluma,
measure and to certify •such c am/ass 'of the votes cast for and against •said measure to
this City Council,
Section 5, The• City Clerk is hereby authorized and directed to certify
to the due adoption of this resolution and to transmit a copy:hereof so certified to the
Board of 'Supervisors of Sonoma County and to file a cop*hereof so certified with County
•Clerk of Sonoma County.
