HomeMy WebLinkAboutResolutions 87-191 N.C.S. 07/06/1987CiTY GLER~( ,~ _ - ~ 1 ~~~'.~" ~lL~tl~~1 ~1~. 87-191 ~. ~, ~, - ~ of cl~e City of Pet~lum~, C~liforni~ RESOLUTION GRANTING JURTSDICTION ~ SUNNYSLOPE ASSESSMENT DISTRIGT, COUNTY OF SONOMA The City Council of the City of Petaluma resolves: Pursuant to Section 10103 of the Streets and Highways Code (Municipal Improvement Act of 1913), the Board of Supervisors of the County o£ Sonoma has submitted to this City Council a proposed Resolution of Intention to order improvements and levy special assessments within a special assessment district to be known as Sunnyslope Assessment District, County of Sonoma, State of Cal'ifornia, together with an adopted boundary map of the proposed assessment district. A portion of the land to be assessed lies within the territory of this City. This Council hereby consents to the formation of this assessment district and to the work described in the proposed Resolution of Intention, a copy of which is attached to this resolution as Exhibit A. This Council, consents to the assumption of ~urisdiction by the County of Sonoma with the understanding that'the Board of Supervisors of the County of Sonoma may hereafter take each and every step required for or suitable for consummation of the work and the levying, colTecting and enforcement of the assessments to cover the expenses thereof, and the issuance and enforcement of bonds to represent unpaid assessments. Thi:`s Council agrees that the County'of Sonoma shall be the "l.ead agency" as defined in the California Environmental Quality Act - for the purpose of complying with the requirements of that statute. The Board of Supervisors of the County of Sonoma resolves: This Board intends to order the following improvement under the authority of the Municipal Improvement Act of 1913: Curb, gutter, sidewalk, eight foot parking lane and two travelled lanes on eaeh of Sunnyslope Avenue and Sunnyslope Road. The parking~lanes and travelled lanes will be asphaltic concrete pavement over aggregate bases. Width curb to curb of Sunnyslope Avenue is uniform at 40 feet, with some existing curb and gutter on the north side to be incorporated into the construction. Width curb to curb of Sunnyslope Road is uniform at 40 fee~. Driveway conforms are included. Curb, gutter~ sidewalk, asphalt overlay, and paving on F Street from the intersection of Sunnyslope Avenue, 120 feet northward to meet existing improvements. Curb and gutter on a short section of Sunnyhill Drive, and asphalt overlay on Sunnyhill Drive, Morning Sun Street and Highland Road. Storm drainage system including pre-cast concrete inlets and reinforced concrete pipe. ~ Six-inch sanitary sewer in a portion of Sunnyslope Road, manholes, cleanouts, and laterals to property lines of building sites as yet~undeveloped. Fire hydrant assemblies are proposed to be installed where service is not yet provided. and electroliers will be installed per City of Petaluma requirements. Aerial photographs indicate that the improvements are likely to fit between existing fence lines and within existing r,ight-of-wag, Therefore, no right-of-way acquisition has been included in this study. Overhead utility lines along Sunnyside Avenue will be installed underground. This Board finds that the land specially benefited by the EXHI~ITA „ improvement is shown within the boundaries of the map en~itled, "Proposed Boundaries of Sunnyslope Assessment Distric~, County of-- Sonoma, State of. California."' This map has been approved by the Board and is:now on file with the C1erk of the Board. The land within the ex'terior boundaries shown on the map shall be designated Sunnyslope Assessment District, County of Sonoma, Sta~e of California. This Board intends to levy a special assessment upon the land within the described distr,ict in accordance with ~he special benefit to be received by each parcel of land, respectively, from the improvement. There shall be omitted from special assessment a11 public streets, allegs and•places and all land belonging to the United S~ates, the State of Callfornia and the County of Sonoma now in use in the performance of a public function. This Board orders that a portion of the cost of the improvement shall be paid from the general fu~nd of the County and that the balance of the cost shali be specially assessed. Where any disparity occurs in level or size between the improvement and private property, this Board determines that it is in the public interest and more economical to eliminate the disparity by doing work on the private property ins~ead of adjusting the work on public property. Accordingly~ work may be done on private property for this purpose with the writ~en consent of the landowner. Private utility damages, as described in Chapter 8.5 (commencing with Seetion 1501) of Part 1 of Division 1 of the Public Utilities Code, shall be~included as a cost of the imp.rovement to be specially assessed. Serial bonds representing unpaid assessments, and bearing interest at a rate not to exceed twelve p~ercent (1296) per annum, will be issued in the manner provided by the Improvement Bond Act of 1915 (Division 10, Street's and Highways Code), and the las~ installment of the bonds sha11: mature not to exceed twenty (20) years from the second ctay of September next succeeding twelve (12) months from their date. ~ ' Th~e procedure for the collection of assessments and advance retirement o'f bonds under the Improvement Bond Act of 1915 shall be as provicied in Part 11.1, Division 10, of the Streets and Highways Code of the State of California. The County will not obligate itself to advance available funds from the county treasury to cure any deficiency which may occur in the bond redemption fund. A determi.nation not ~o obligate itself shall not prev.ent:the County from, in its sole discretion, so advancing funds. This Board finds that the Special Assessment Tnvestigation, Limitation and Ma,jority Protest Act of 1931 (commencing with Section 2 ; . . . 2800, S:tr.eets and Highways Code) do'es not apply to these proceedings. '~ -- This Board appoints Donald B. Head as Engineer of Work for this pro~ect, and directs the preparation of the report required by Section 10204 of ~he Streets and Highways Gode. In the opinion of this Board, the public interest will no~ be served.by allowing owners of assessable lands to enter into a contraet.for the.work.of improvement as otherwise permitted in Section 20485 of the Public Contract Code. The amount_of any surplus remaining in.the improvement fund after completion of the improvement and payment of all claims shall be transferred to the general. fund if the surplus does not exceed the lesser of one thousand cloll:ars ($1000) or five percent (5%) of the total amount expended from the fund.
