S. .~ of the City of ~Petaluma, California RE~SOLUTION APPROVING DECORATTVE LOGO ON TOWER CLOCK ~ AND VARIANCE TO ALLOW WALL SIGN ON THE STEPHENS BUILDING ON LOT AT SOUTHWEST END OF DYNAMIC STREET ~ ASSE•SSORS PARCEL NO. 007-391-11 WHEREAS Richard Lieb appealed a staff decision against and sought a variance to .a11ow a wall-mounted sign saying Northbay Companies and the initials N. B. D. on a tower clock both oriented to Highway 101, and WHEREAS the Planning Commission held a public hearing on the variance request and considered the matter at their meeting of May 27, 1987, and WHEREAS the Planning Gommission deadlocked three to three on several motions on the matter and thereby per their rules of order disapproved the requested variance, and WHEREAS Mr. Lie6 appealed this de jure denial to the City Council, WHEREAS the City Council considered the matter at their meeting of July 6, 1987, NOW, THEREFORE, BE IT RESOLVED that the proposed tower clock Iogo is exempt from the limitations of the sign ordinance of the City of Petaluma and therefore,, :allowed based on the following findings: 1. That the p:rop.osed logo is not a sign but is a decorative motif on the clock face-. NOW, THEREFORE, BE IT FURT:HER RESOLVED that the proposed variance - to allow wall-mounted sign oriented toward the £reeway on the Stephens b,u'ilding; reading "Northbay Companies" together with the "N . B. D.!' logo as sh'own on the' dr.a.w,ings presented to the City Council at the meeting of July ~ 1 . Reso. .87-19:2 NGS 6, 1987, ;i"s~ hereby g~ranted based on the following findings and subject to the folYowing condi"tions : ~ ~ _ Fin~din g;s : 1_. That there are peculiar and unusual conditions inherent in the property in question sufficient to cause a hardship and that such conditions are not common to all or most of the properties in the immediate area in that this is a long triangular shape property with frontage only on a cul-de-sac and along public highway 101. 2. That a hardship peculiar to the properfy and not created by an act of the owner exists in that such a trianguTar shape lot was the only one possible given the configurations of the bordering freeway and railroad lines between which the property lies. 3. That such a variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same zoning district and in the vicinity and that a variance, if granted, would not constitute a special privilege of the recipient not enjoyed by his neighbors because other buildings bordering the freeway with frontage roads have signs gqing into the freeway and are nearly as close to the freeway as tliis building will be and the applicant wants to iden,tify his building after the great investmemt he has made to create .it. 4. T.hat the authorization of such a variance shall not be of sub'stantial ~ detriment to adjacent property and will not materially impaix• the purpose of t'he ordinance with the p.ublic interest because no adjacent proper:ty owners known to the Council could realiz.e a detrimental ~effect frorn the one sign and the sign is small relative to the size of the very lar:;ge building:. BE~ IT' FURTHER RESOLVED based on the findin.gs set forth above, thz~t the above referred to variance for a wall sign oriented toward the freew<~y on :?~ , ~ the Stephens building is hereby approved subject to the condition;s set forth below and incorporated herein as follows: 1. That the 2' to 3' individual letter wall sign reading "NorthBay Companies" with the 4' diameter logo "N . B. D." on the south end of the fascia of the south building elevation as shown on the drawings presented to the City Council at the meeting of July 6, 1987 shall be the only sign orienting to the freeway permitted by this variance. 2. That even in the event NorthBay Drywall Company and the present owner are no longer associated with this building, no other sign shall be permitted to replace this sign under this variance. reso.stephens/reso8 Under the power and authority conferred upon this Council by the Charter of said City.
