Resolution No. g~-19~ N C.S. of the City of Petaluma, California RESOLUTION APPROVING I5SUANCE OF A MITIGATED NEGATIVE DECLARATION PUR5UANT TO CEQA FOR THE CREATION OF THE FOWLER COURT SUBDIVISION LOCATED AT 760 BODEGA AVENUE (NORTH SIDE OF BODEGA BETWEEN RUTH COURT AND N. WEBSTER STREET AND BODEGA INTERSECTION.) (A.P. NO. 006-480-21) WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for a proposal to create a 4 lot residential subdivision, at 760 Bodega Avenue (North side of Bodega between Ruth Court and No. Webster Street and Bodega intersection; and WHEREAS, an initial study which noted traffic, drainage, and visual impacts has been prepared for the area and has been reviewed by the Community Development and Planning Department and the Planning Commission; and, WHEREA5, the results of this study has indicated that approval of this project as conditionally approved will not trigger any significant adverse environmental impacts; and, WHEREAS, staff and the Planning Commission have recommended that a mitigated negative declaration be issued on the above project; NOW, THEREFORE, BE IT RESOLVED that the issuance of said Negative Declaration pursuant to the California Environmental Quality Act is hereby approved, based upon the following findings: 1. In the event of an archaeological find during construction, this project bears a condition of approval to require that this finding be authoritatively evaluated. The traffic impact of this four-unit 2 subdivision will be slight relative . of the to the capacity existing road network and the impact of the , subdivision on~ -Bodega ~Avenue will be mitigated by the fact of the recorded agreement to switch the a ccess of the three uphill lots to a future street parallel to Bodega Avenue which will enter Bodega Avenue at a controlled intersection. 3. The drainage impacts of the project will be taken into account in detail in the improvement plans for the project which will be reviewed and approved by the City Engineer prior to issuance of Final Map . 4. The project as conditionally approved does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or uf,s. ,~~~......g~W 193...... v.c.s. t~ animal eommunity, reduce the number or restrict the range of a rare or endangered plant or animal, or eliminate important examples of major periods of California history or pre-history. 5. The project as conditionally approved does not have the potential to achieve short term to the disadvantages of long term environmental goals . 6.
