AUTHORIZING ACCEPTANCE OF
EXCESS FEDERAL PROPERTY
BE IT RESOLVED the City Manager is authorized to execute any
documents in connection with the City's receipt of excess Federal property.
BE IT FURTHER RESOLVED the City of Petaluma has received from the
State, the loan of one (1) Kaiser 14 ton truck, Property No. 13011, NFC No.
1105824120 to be used at the Petaluma Municipal Airport.
Under the power and authority conferred upon this Council by the Charter of said City.

(a) All such Federal Excess Property loaned will be for an
indefi-nite period of time.

Use must be rest'ricted to this purpose.
(c) Ownership shall remain in the Federal Government. :ne Locai
Agency may modify, improve, buila-up o-r xepair property
acquired, The Local Agencg will mark arid continuo;zsiy
main~tain such ma'rks, signs, de.cals or emblems on the-pro~erty
s'o as to both iaentify and record it as property of the

(e) The Locai Agency sna11 be responsi°ole for the proper care,
security, maintenance. and utilization of this property to
assure its continued~use as contempiated herein unti~ such
time as the S:tate issues a formal reiease from such
responsibility.
(f) When any property..loaned or assigned to.the Local Agency
hereinunder is Tost, worn out; no longer. serviceable or no

2. In the event that all of or any one or mo're pieces of equipment
provided to the local agency nereund.er is assigned, iost,
stolen, worn out, destroyed, damaged or otherwise rendered
useless or unavailable for its piirposes intenaed nereunder and
it is cl:early estai~Iished ~hat such assignment-or Ioss occ;arr-_ed
while or as a result of a use other than that state~ in (~j
aqove, then the S'tate shall have the right and t:~e oo,iigation
to retake such equ:ipm~nt and/or a,ssess the Local Agency for
damages up to the value, establisned by the Stdte ~or each
such piece o'f equipment, immediately pr.ior to such assirnment,

3. In the event of any dis.pute gver any eq.uipment loaned to tne
LocaI Agency hereunder or any of the terms or conditio.r.s

its decision.shall be binding and'f.inal. °
4. The parties hereto agree that the Local Agency, their officers,
employees, agents, servants, contractors, volunteers, paid cail
firemen and others acting on behalf of the Locai Agency performing
under ttie terms~of this Agreement, are not acting as officers
or employees or agents of the State or of the ~'ederai Government.
5. The Loca1 Agency "agrees to defend, iridemnify, save and nold
harmless the State as defined herein, and the Department of
Forestry, thei,r officers, agents and ~em,ployees agains•t any and
aI1 claims, demands, causes of acti.on', or iia'bility of any kina
whatsoever ari.sing qut of the acts'.of th'e Loca1 Agency, its
agents or employees.in the perfarmance of'.any function provided
for under the terms af thi,s Agreement.
6. The period of thi,s Agreement is for a period of one year from
the date shown above amd thereafter on a year-to-year basis
until terminat"ed by either party after giving notice 180 days
i,n advance of such termination to the otner party.
7. During t'he ter-m stated'in (6), aoove; this Agreement, at the
