WHITREAS, on the Mitch day of April, 1963, the City Council

of the City of Petaluma, !Sonoma Oount'y, California, adopted' its Reso-

lution of Intention No j-.89 N05 or the construction of imprOvements
and the acquisition of ,protorty necessary thereto in Assessment District
No . 8, North San Francisco tay industrial Park Unit One, City of
PetaluMa, County of Sonoma, State of California, and referred said pro-
posed construction of improvements arcd ,acouisitions to GEORGE. S. NOLTE,
Engineer of Work fOr aid assesssent district,; and •
UHEREAS, said City CoL,nc13 directed that, said Engineer of
Work make and file with, the City Cle-rk of the said City of Petaluma a
report in writing in accordance v74.th tha provisions and requirements 'of
the Municipal tmprovement' Aet of 1913 of the State of California; and
WHEREAS, said GEORGE Sc., NOLTE, Engineer of Work, did, on
the 15th day of April, 1963, file with the City Clerk of the City of
Petaluma his report in adeordanoe with the said Resolution, and said
City Clerk has presented said report to this City Council for considera-
tion;
NOW, THEREFORE., BE IT RESOLVED by the City Council of the
City of Petaluma, Sonoma County, California, and this City COuncil
hereby finds :
A. That the report made and filed by GEORGE S . NOLTE on
the 15th day of April, 1963, contains all df the requirements provided
for said report by the provisions of the Municipal Improvement Act, of
1913, including (I) enec4ications,5, ((2) plans and profiles and estimates
of cost,; (3) ,aspessment diagram and aSsessment; deecrirPtilonS of
• easements and/or rights of way to be acquired, if any.
B. That said report and each and, every part thereof, is
sufficient in every Particular and it is hereby determined that said
report shall stand as theirepert for all Sdbsequent proceedings under
said Municipal Improvement Act of 1913; and

BE IT FURTHER RESOLVED that 'Monday, the 3rd day Of June:;
196:3; at, the hour of- 8:00 o ' clock P-:-M. of said day', at the. meeting
place of the City Council Of the `City Of Petaluma, located in the.
City Hall, Petaluma, California, ;is hereby fixed 'by this City Council
as'. the time and place for hearing protests with relation to the proposed
' construction of improvements and the acquisitions necessary thereto de-
scribed in said report; that any•{person interested in objecting to said
construction and acquisition; the grades to which the work will be
done, the extent of the assessment district, the. assessment, or the . •
engineer' s estimate of the cost aria expenses, or any other act or de-
termination of the Engineer of Work Or' the City Council of the' City of
Petaluma, may file protest in writing with the City Clerk of the City
' of Petaluma at or before the hour fixed herein fOr hearing thereon; and
BE IT FURTHER, 'RESOLVED, and the City Council of the City of
Petaluma. hereby finds, that the owners of 'lOC% of the area Of the
property within the boundaries of the district proposed to be assessed.
have filed with this City `Council waivers: waiving (1) any posting of
any notice of hearing, (2) , any mailing of any- notice of hearing; (3 )

' any publication of any notice of `hearing; all 'as required by the provi-
sions of the Municipal Improvement Act of 1913; that notwithstanding
said waivers, this City Council hereby determines and orders that the
City Clerk of the: City' of Petaluma shall publish a Notice of Improve
' merit pursuant to Section 6066 of the Government 'Code of the State of
California., the first Of whioh. said notices to be first published at
least twenty (20) days :prior to .the date herein -set for hearing of
'protests; and
BE ITFURTHER :RESOLVED that the City Clerk of the City Of
Petaluma be, and she is. hereby, further directed" to cause notices of
the passage of this Resolution to be posted on. ,all- of the -open' streets
within the district described in the Resolution of Intention at not
more than three hundred feet :apart on each street so posted, 'in ac-
. cordance with the requirements of' Section 10302 and 10303 of the
Municipal Improvement :Act of 1913; and I
BE IT: FURTHER RESOLVED' that this City' Council herebly orders
that the ,.construction .of improvements and the acquisition of property
necessary thereto,, as described in said. Resolution of Intention, be

made and cloned?' accordance with plans; and specifications and profiles
for said work. The plans and specifications with, said report are
hereby adopted as the Plans, profiles and specifications for ,the doing
of said work and improvements, and. said City Council does hereby order
that bids shall be received for the doing of said work and.. improvements
on the 27th day of May, 1963, at the hour of 2:00 o 'clock P.M. of said
day. Said proposals or bids shall be delivered on or before 2:00
o 'clock PAM'., of said day at the office of the City Clerk of the City
of Petaluma, City Hall, Petaluma, California, which said time, and place
, are hereby fixed as the time and place of a public •meeting at which
said bids will be publicly opened, examined and declared. Said bids,
after being publicly opened, examined and declared, will be calculated
by the Engineer of Work of Assessment District No . 8, their report
returned to the City Clerk, and the report of the results of the bidding
and the calculations of the Engineer of Work will be reported to the
City Council of the City of Petaluma at the ,next regular meeting there-
of. The City Council of the. City of Petaluma hereby reserves the
right to reject any and all proposals or bids! should it deem this
necessary for the public good, and also the bid of any bidder !who has
been delinquent or unfaithful in any former contract with the City of
Petaluma.
I HEREBY CERTIFY that the foregoing Resolution was duly and
regularly adopted by the City Council of the City of Petaluma,' Sonoma
County, California, at a regular meeting thereof, held on the 15th day
of April, 1963, by the following vote, to wit :
