WHEREAS, the Councij of the City of Petaluma did on the 1st day of July, 1963, adopt its resolution of intention No. 3237 N.C.S. , declaring its indention to vacate and abandon and close to public use that certain easement for street purposes running across the lands of David-:G. 1Cader on West Street in the City of Petaluma, hereinafter described, which resolution was duly and legally posted upon the bulletin board of the City Hall by the City Clerk of said City, and WHEREAS, after the adoption thereof, notices of the passage of said respi,ution, headed "Notice of Vacation, Abandon- ment and the Closing to Public Use of a Certai'n Street or Portion of Street in Petaluma,; Ca�lif.ornFa, " were duly and legally posted in the time, form and !na"nner as required by law as shown by the 1 affidavit of posting on floe in the office of the City Clerk, and WHEREAS, said Council has, on the 5th day of August, 1963, held a public hearing for the purpose of hearing the evidence of any person interested i:n or objectfno to said proposed abalndon- ment and vacation,. and 1 WHEREAS, said Council having duly received and considered evidence concerning the jurisdictional facts in this proceeding 1 • ` if i'.l and finds from all the evidence submitted, the street or portion of street hereinafter described is unnecessary fo,r present or prospective public street purposes., and the said Council of the City of Petaluma having now acquired jurisdiction to order the, pro- posed abandonment and vacation; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Petaluma, pursuant. to and in accordance with the authority con- tained in the Street Vacation Act of 194.1 , that the following , 1 easement for street purposes in, said 'City, be and, the same is , hereby ordered vacated, abandoned, and forever closed to public use : Beginn-ing at the northwest corner of Lot 559 as shown upon Stratton' s lap of the City of Petaluma, and running ;thence N i`° 50 ' ;i 300.60 feet to the southwesterly Line of Howard Street as shown upon said map and the, actual .point of beginning of the tract of land Herein described to be abandoned, thence from said point of beginning iQ 1 17° 314' along the :s`outhwest 1i`ne of Howa rd Street 21e feet more or less to the southerly line of West Street ; thence along the southerly line of West Street N '35° 25 ' E 95.69 feet more or less to the north- easterly line of Howard Street ; thence along 'the northeasterly line of Howard Street S 47° 3Lr' E 32.53 feet more ior less to a ood'n; thence S l.° 50 ' E 97.75 feet more or less to the point of be- ginning. BE IT FURTHER RESOLVED that the City Clerk is directed to cause a certified copylof this resolution, attested by said Clerk under the seal of said City,,, to be -recorded in the office of the Recorder of Sonoma,) County, Calif'ornia.
