DENYING APPEAL BY LAWRY-COKER-DESILVA ARCHITECTS
REGARDING A USE PERMIT FOR CONVENIENCE MARKET AT
5300 OLD REDWOOD HIGHWAY, AP NO. 137-010-63
WHEREAS, an application for a use permit to allow a convenience market
and general retail building was filed with the City in November, 1986 by
Lawry-Coker-DeSilva, Architects, on behalf of the Southland Corporation,
property owner; and
WHEREAS, on January 27, 1987 the Planning Commission denied this
application without prejudice after a duly publicized public hearing during
which they considered all pertinent data and testimony both written and
verbal prior to rendering their decision on this matter; and
WHEREAS, the applicant filed a letter of appeal on February 4, 1987; and
WHEREA5, the City Council considered this matter, including pertinent
information presented at the Commission hearing, written information, and
public testimony from the applicant and all interested persons who spoke on
this matter at their regularly scheduled meeting on May 4, 1987; and
WHEREAS, the Council found that the project site is in a critical location in
terms of visibility, traffic flow, and unique partly-developed environment
that requires cooperative design with surrounding properties to reduce
traffic hazards by reducing the number of driveways, creating joint access
with neighboring shopping centers, providing adequate trash storage and
truck loading facilities, better distribution of compact parking spaces, and
an architectural design to avoid a mixture of incompatible or inharmonious
buildings at such a prominent site; and
WHEREAS, the proposed site plan gave inconclusive or no evidence that
these concerns would be satisfied; and

WHEREAS, the owners of adjacent property indicated to City staff a
willingness to work with this applicant to achieve safe, efficient, and
compatible design; and
WHEREAS, in four months since application, no arrangement for joint access
had been obtained; and
WHEREAS, the Council directed staff to consider all incrementally developed
properties in locations of high visibility and critical traffic patterns as an
integrated whole to achieve efficient design in the interest of the overall
community's health, safety and welfare; and
WHEREAS, a "denial without prejudice" would allow the applicant to
redesign the proposal and reapply for a use permit without time
restrictions;
NOW, THEREFORE, BE IT RESOLV~D that the City Council hereby denies
the appeal of the Planning Commission decision on this matter and upholds
the Planning Commission decision to deny without prejudice this application
for a use permit to allow a convenience market and retail building at 5300
Old Redwood Highway, the northeastern corner of Old Redwood Highway
and MeDowell Boulevard North.
