HomeMy WebLinkAboutResolution 2004-027 N.C.S. 03/01/2004 Resolution No.2004-027N.C.S. of the City of Petaluma, California AMENDING THE ROTATION TOW LIST FRANCHISE AGREEMENT ELIMINATING FEES CHARGES TO THE TOW OPERATORS FOR TOWS UNDER VEHICLE CODE SECTIONS 22651(k) and. 22651(0) WHEREAS, on July 7, 2003, the City Council adopted Ordinance No. 2153 N.C.S. authorizing the City Manager to sign non-exclusive Rotation Tow List Franchise Agreements and establishing Tow Franchise Fees; and, WHEREAS, the City entered into the current Rotation Tow List Franchise Agreements on August 19, 2003, with.Petaluma Tow and Downtown Tow; and, WHEREAS, these Agreements provided for a review of the terms of the Agreements and the Franchise Fee; and, WHEREAS, the tow operators have requested Amendments to the Rotation Tow List Franchise Agreements relating to certain Franchise Fees; and, WHEREAS, Ordinance No. 2153 N.C.S. provides that the Rotation Tow List Franchise Agreement and Franchise Fees may be subsequently modified or amended by resolution of the Council. NOW, THEREFORE, DE IT RESOLVED, ORDERED, AND DECLARED that the City Manager is authorized to enter into Amendments to the Rotation Tow List Franchise Agreements with the current tow operators, Downtown Tow and Petaluma Tow, and Agreements with any subsequent tow operators, eliminating the $20 Franchise Fee for those cars towed under Vehicle Code Sections 22651(k) and 22651(0). Resolution No. 2004-027 N.C.S. BE IT FURTHER RESOLVED that the City Manager may execute the Amendment to said Rotation Tow List Franchise Agreements in the form attached hereto as Exhibit A. EXIiIBI'I' A AMENDMENT TO CITY OF PETALUMA POLICE DEPARTMENT ROTATION TOW LIST FRANCHISE AGREEMENT WHEREAS, a Rotation Tow List Franchise Agreement was entered into on between the City of Petaluma ("City") and ("Contractor"); and, WHEREAS, the City Council. has authorized the City Manager to execute this Amendment. NOW, THEREFORE, for good and valuable consideration, the parties agree that Section 4 of said Rotation Tow List Franchise Agreement shall be amended as follows: Section 4 -FRANCHISE FEE A. Fee. Contractor shall pay the City a franchise fee as follows: 1. $75.00 per vehicle tow pursuant to the STOP Vehicle Forfeiture/30 Day Impound List; and 2. $20.00 per vehicle for all other tows pursuant to this Agreement, except for tows pursuant to the Police Special Services Rotation List, the Abandoned and Junk Vehicle Rotation List, and vehicles towed pursuant to Vehicle Code Sections 22651(k) and 22651(0).
