HomeMy WebLinkAboutResolution 2010-015 N.C.S. 01/25/2010Resolution No. 2010-015 N.C.S. of the City of Petaluma, California A RESOLUTION OF TI~E CITY COUNCIL OF TI-~E CITY OF PETALUMA APPROVING AN AMENDMENT TO-THE GENERAL PLAN I,AND USE MAP FOR ASSESS012'S PARCEL NUMBER 019-330-009 WHEREAS, the City of Petaluma wishes to amend the General Plan Land Use Map to designate the above referenced parcel to Open Space; and, WHER~AS, the Planning Commission reviewed the request on June 23, 2009; and, WHEREAS, all reports and comments from the Planning Commission were forwarded to the City Council; and, WHEREAS, the City Council held a duly noticed public hearing to consider this amendment on January 25, 2010, and considered all written and verbal communications before rendering its decision; and, W~IEREAS, the applicability of the California Environmental Quality Act was considered and proper action has been taken by the City Council to approve a Class 8 Categorical Exemption thereto. NOW, THERE~'ORE, BE IT RESOLVED that the Petaluma City Council hereby approves the requested amendment to the General Plan Land Use Map to adopt the designation as outlined above based on the following findings: That the proposed amendment is deemed to be in the public interest. The amendment to the General Plan land use map would ensure that the existing habitat and species existing on the subject property shall be protected and enhanced through the authority held by the City of Petaluma. 2. That the proposed amendment is consistent with the initiative and applicable General Plan Sections pertaining to the Urban Growth Boundary, in that no development or extension of public services will be provided on this property; therefore, no amendment to the UGB is proposed in conjunction with this General Plan Amendment. That the proposed actions ("project") are consistent with the~ General Plan 2025, in that: Policy 2-P-31 states: "Enhance ecological diversity, education, and enhancements along the Petaluma River and Estuary". In addition, extensive policies are contained in Chapter 4, The Natural Environment, calling for protection of habitat and special status species and their supporting habitat (see Goal 4-G-1 and applicable policies and programs for Biology and Natural Resources, pages 4-4 and 4-5 of the General Plan 2025). The proposal to designate the property as Open Space and annex the property into the City to allow enforcement of no trespassing restrictions is consistent with these preservation policies. 4. That the proposed project will not be detrimental to the public welfare, will be in the best interests of the City, and will be in keeping with the general intent and spirit of the Zoning Regulations of the City. 5. That the proposed project has complied with the requirements of CEQA through the approval of a Class 8 Categorical Exemption for the proposed actions, and no further environmental analysis is necessary. Under the power and authority conferred upon this Council by the Charter of said City.
