HomeMy WebLinkAboutResolutions 87-092 N.C.S. 04/13/1987~~,. _ .~~+' ' FZesolution No. 87-92 N C.S. of the City of Petaluma, California DENYING AN APPEAL BY CHIEF AUTO PARTS TO CERTAIN CONDITIONS OF A PLANNING COMMISSION USE PERMIT FOR AUTO PARTS STORE AT 201 SOUTH MCDOWELL BLVD. , AP NO. 007-280-38 WHEREAS Chief Auto Parts applied for a Conditional Use Permit to allow creation of an auto parts store on their lot at 201 South McDowell Blvd. ; and WHEREAS the City Planning Commission held a public hearing on the proposed Use Permit on February 24, 1987; and WHEREAS the Planning Commission reviewed the matter and granted the Use Permit with conditions; and WHEREAS Chief Auto Parts appealed the Planning Commission's conditions for the aforementioned Use Permit; and WHEREAS the City Council heard the appeal of this matter at their meeting of April 6, 1987; NOW THEREFORE BE IT RESOLVED, that the City Council hereby finds as follows in this matter: Fin dings 1. The proposed structure and use, subject to the conditions, will conform to the requirements and the intent of the Petaluma General Plan and Environmental Design Plans and this use will not, under the circumstances, constitute a nuisance or be detrimental to the public welfare of the community. 1 ii~s. n~~.....8.7.-.9.2...._.. n.cs. 2. The location is a prominent one at one of Petaluma's busiest intersections and, the architecture should be of high quality, especially on both sides which face the .streets, and landscaping should be full anal carefully considered to create a pleasing view of the site from public spaces adjacent. 3. Traffic volume and speeds on E. Washington Street adjacent to the site are high, and the driveway onto the site from the street is close to the intersection so turning movements there can be expected to adversely affect traffic flows through the intersection. 4. There are few mature trees on the site and these help shade paved areas adjacent and improve the overall appearance of the site. NOW, THEREFORE, BE IT FURTHER RESOLVED the Council hereby denies the appeal by Chief Auto Parts, Inc. of Planning Commission conditions for a use permit for a Chief Auto Parts Store at the corner of E. Washington and McDowell Blvd. , and upholds those conditions which continue in force as follows (~:nn r~i1-inn c 1. The following conditions of the Fire Marshal must be met: a. Provide second exit from sales and display area - "cannot exit through storage area" . b . Provide signs over exit doors stating - "This door to remain unlocked during business hours" . Letters shall not be less than 1" high. c. Post address at or near main entry door - minimum two inch letters . d. Provide fire extinguisher 2A rated ABC dry chemical type as required by the Fire Marshal, location on plan acceptable. e. No extension cords.. All equipment and appliances to be direct plug in . 2 Reso. 8Z-92 NCS ' .. f . Provide metal or flame- re ardant plastic waste cans . 2. There shall be no storage or sale. of vehicles on this site, no repair or parts installation,. no outdoor display of parts, tires or other products related to the business and no parking lot vendors; i.e. , no sales of laser art, velvet paintings, tools, pottery, etc. 3. This use permit may be recalled to the Planning Commission for review at any time. due to complaints regarding traffic congestion, noise generation or other potentially objectionable operating characteristics. At such time the Commission may' appeal the use permit or add or modify conditions of approval. 4. This project shall be subject to review by SPARC. SPARC shall particularly require an . upgrade to the architecture of the proposed building at this prominent site, the. shielding of public views of the loading area by .ample landscaping, the addition of windows on the McDowell Blvd, ,elevation, the protection of parking spaces and. the building by landscaping,,, and general upgrading of the perimeter landscaping of this site. 5. Free-standing signs shall be five foot high maximum, monument style only, in conformance with City policy on such signs for properties on E. Washington Street. 6. The driveway on East. Washington Street on-site shall. be closed and the curbcut removed and sidewalk replaced to the satisfaction of City staff. The ar-ea thus freed shall be reconfigured with landscaping and parking to SPARC approval. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Council adds the following conditions to this use permit: 3 Reso~_ :87-9,2 .NCS 7. The site plan and architecture plans for this project shall be referred to the City Council for approval after these plans have been reviewed by the Site Plan and Architectural Review Committee . 8. The site plans shall be such as to preserve the existing pine trees on the northeast side of the site . Under the power and authority conferred upon this Council by the Charter of said City.
