It is found, ordered and declared that a public nuisance exists at the property known as 400 Hopper Street, Petaluma., California, and constitutes a hazard to the public health, welfare and safety. 2. The Chief Building Inspector of the Community Development and Planning Department is .hereby ordered to abate said nuisance by the demolition or removal thereof, by July 1, 19:87, or to cause a change to the floodway area by July 1, 1987. BUILDING_ LOCATED AT 400 HOPPER STREET, PETALUMA', A PUBLIC' 1`lUISANGE AND ORDERING SAID`;NUISANCE TO B-E AB'A'TED. WHEREAS, Eugene B. Ceccotti, Vice Chairman/'CEO of Shamrock Materials, Inc. , is the owner of record of certain property at 400 Hopper Street, (A.P. No.7-16Q-0:8) Petaluma,, California:; and, WHEREAS, it was alleged by the Chief Building Inspector of the Community Development and Planning Department for the City of Petaluma., that said use and occupancy of the manufactured building on the premises is a violation of the Petaluma Zoning Ordinance Article 16, and specifically Sections 16-502 and 16-5.03 as well as Uniform Building Code Section 301. WHEREAS, the said property owners were notified of a hearing to be held on the question of whether such nuisance did in fact exist; and, " WHEREAS, said hearing was held on January 20, 1987, and evidence, both oral and documentary., was heard. and considered by the Council on the question of whether a public nuisance did, in fact, exist at 400 Hopper Street, Petaluma, California 'and whether the cost of abating such nuisance _ should be assessed against aid property owners. t~ Eugene B. The cost of said abatement, if not undertaken by Shamrock Materials, Inc. , shall be assessed against Shamrock Materials, Inc. , and if not promptly paid, the City shall institute legal action to recover said monies from the Shamrock Materials,Inc. Under the power and authority conferred upon this Council by the Charter of said City.
