KERR FOR AUDIO VIDEO AND MORE TO A PLANNING COMMISSION DECISION UPHOLDING PLANNING DIRECTOR ADMINISTRATIVE ,DECISION LIl`;4ITING ALLOWABLE HEIGHT OF THE FREE-S*'I'ANDING SIGh1 ON EAST WASHINGTON STREET TO FIVE FEET FOR A BUSINESS AT 627 EAST WASHINGTON STREET, ASSE5SOR's PARCEL NUMBER 007-057-40. WHEREAS the policy restricting free-standing signs on East Washington Street to a maximum height of five feet has been in force since 1978; and WHEREAS, in the spring of 1986 a representative from Audio Video and More, asked the Planning Department about height limit of free-standing signs on East Washington Street and were told that that limit was five feet; an d WHEREAS, in June of 1986 it came to Planning staff's attention. that a two-foot high sign advertising Audio Video and More had been placed without benefit of permit on top of the four foot sign existing a.t 62? East Washington Street, and WHEREAS, on July 1, 1986 Planning staff sent a letter to Audio Video and More advising them that there. was no record of a permit for that sign, and WHEREAS, on July 25, 1986, Planning staff again advised representatives from Audio Video and More that the height limit for free-standing signs on East Washington Street was five feet, and WHEREAS., Audio V-ideo and More subsequently appealed the administrative decision regarding sign height limits to the Planning Commission, and ;~. ~ ~. - WHEREAS the Planning Commission held a public hearing on November 11, 1.98:6 and. voted five to two to deny the appeal,. a.nd WHEREAS the applicant. appealed the Planning. Commission decision to the City Council, and WHEREAS the City Council held a public meeting on the matter at the meeting of January 20, 1987, and ~ - WHEREAS on January 20', 1987, the City Council adopted Ordinance No. 1668 N.C.S. con=taming amendci-ients .to the: Zoning Ordinance including addition of Section 21-204.3N to read as follows: "N. All free-standing signs for properties within Fast. Washington Street frontage shall be a monument, .low profile style, not exceeding five (5) feet in height measured from the grade of the nearest public sidewalk." NOW THEREFORE BE IT RESOLVED that the City Council hereby denies the appeal of the Planning Commission decision .and upholds the Planning Department administrative decision limiting the h-eight of the free-standing sign at 627 East Washington Street to five feet and affirms that the existing sign added by Audio Video and More without permit which exceeds five feet shall. be brought into conformance with this height limit, as specified in ordinances in effect at the time of application for a sign permit for this sign .
