HomeMy WebLinkAboutResolutions 86-253 N.C.S. 09/15/1986-~ -: ~ ~ ~~ __ Resolut~ion~ '~~., 86-253 N.,'C. ~. of the City of Petaluma, California RESOLUTION BY CITY COUNCIL UPHOLDING APPEAL OF STAFF DENIAL OF PARCEL MAP (.LANDS OF CARNAZOhA) WHEREAS, the City, Erigineer~ denied an application for parcel map on Lands of Carnazola, 1024 McNear Avenue, Sonoma County Assessor's Parcel No. 008-423-21, because the proposed land division failed to connect two existing stub-ends of Phillips Avenue; and WHEREAS, staff denial of the Parcel Map was appealed pursuant to Petaluma Municipal Code Section 20...20..100; and WHEREAS, the Planning Commission held a duly noticed public hearing on August 27, 1986 to consider the appeal during which all public input both /, written and oral was received and considered prior to rendering their l recommendation to the City Council; and PdHEREAS, the Planning Commission recommended that the City Council uphold the appeal on the issue of street alignment (i.e. permit Phillips Avenue to remain unconnected) provided adequate turn-around area is provided for vehicles; and WHEREAS., based on staff's recommendation, the Planning Commission further recommends that only the issue of street alignment be decided at this time so t-hat proper improvement plans may then be prepared by the applicant and reviewed by staff based on the approved street alignment; and WHEREAS, the City Council held a duly noticed public hearing on this matter on Septer_mber 15, 1986 during which all public testimony, staff recommendation and Planning Commission recommendations were considered; ~. ~ ' _ ._ NOW, THEREFORE, BE IT RESOLVED, that :tle City Council upholds the ap,p.eal of ,staff denial of 'said parcel map because of street alignment based orl.the following finding-s: - - 1. Approval of this .appeal does not include. approval of the parcel ,map,, but rather determine's only that Phillips Avenue need not be connected - through the subject property. ?.. The connection of Rhillips Avenue on the project site is not desirable because it would result in unwanted traffic patterns, less efficient use of the residential. property, and unnatural grade changes on this steep hillside parcel. 3. Adequate emergency vehicle turn-arouxids shall be provided. in the final parcel. map design `at both stub-ends of Phillips Avenue to staff satisfaction. 4. Subdivider- shall secure a.11 .approvals and change the street name for the portion of Phillips Avenue intersecting with .Canyon Drive. BE IT FLIRT-HER RESOLVED that parcel map approval for Lands of Carnazola be referred 'to the Planning Comms'sion:.so that a recommendation. on the entire parcel map be formed based on this determination of street alignment, said recommendation. of the Commission then ~ to be taken to the City Council for review and, action .
