HomeMy WebLinkAboutResolution 2004-010 N.C.S. 01/26/2004 • Resolution No.2004-010 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE POLICE DEPARTMENT TO ACCEPT A TRAFFIC SAFETY GRANT FROM THE CALIFORNIA OFFICE OF TRAFFIC SAFETY FOR AMINI-GRANT FOR DUI ENFORCEMENT IN THE AMOUNT OF $28,200 WHEREAS, the City of Petaluma Police Department desires to undertake a certain project designated the California Sobriety Checkpoint Program, to be funded through the California Office of Traffic Safety; and., WHEREAS, the City Manager of the City of Petaluma is authorized, on its behalf, to submit the attached proposal to the California Office of Traffic Safety and is authorized to sign and approve on behalf of the City of Petaluma the attached Grant Award Agreement, including any extensions or amendments thereof; and, WHEREAS, the applicant agrees to the requirements for said project (including any amendment thereof) under the program and the funding terms and conditions of the California Office of Traffic Safety. NOW, THEREFORE, BE IT RESOLVED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the. authorizing agency. The State of California and the Office of Traffic Safety disclaim responsibility for any such liability. BE IT FURTHER RESOLVED that grant funds received shall not be used to supplant expenditures control by this body. METHOD OF .PROCEDURE Operational Plan Phase I Preoperational Data Collection. (October 1, 2003-December 19; 2003) Base.year data will be collected by existing staff for the two enforcement periods (December 19, 2003 thru .Tariuary 4, 2004 and June 25, 2003 thru July 10, 2003) identified for DUI checkpoint enforcement (OTS-137a and OTS-137b). .li Phase II Personnel Selection and Training (October 1, 2003 -December 19, 2003) It is anticipated that a predetermined number of supervisors, uniformed 'officers, and clerical staff, community service officers or lab Technician will staff each DUI Checkpoint on an overtime basis. Any roll .call DUI Checkpoint Training needed must be provided by the applicant agency. (No overtime funds will be allocated for training.) ' Phase III Overtime Checkpoint Operational Periods (December 19, 2003 -January 4, 2004) Supervisors, Officers; and support personnel will be deployed, on an overtime basis, at locations and on dates selected for DUI checkpoints. Phase IV Post Operational Data Gol ection (January 4, 2004 -January 16, 2004) Prepare and submit to OTS, enforcement data report from First Clieekpoint Operational Period, along with corresponding base year data from First Operational Period (OTS- 137x). This checkpoint compensation is based on the following minimum eri.teria. Each checkpoint will be operational for a minimum of 10 hours and will be staffed on an overtime basis only, by a minimum of '8 sworn personnel, 1 , of which will be supervisory level, and 1 non-sworn personnel. Since the beginning of the DUI Holiday Crackdown on December 13, the Petaluma. Police Department has made . ~a 20 DUl arrests.
