Regericy:has .worked closely: with; City staff to ,negotiate :the proppsed conditions of approval posed by the
Manning Commission and City Council. Below is:a list of th,cse conditions-with Regency's response as#o
whether the conditions-ere~amenable or-not fo Regency.and Target:.We>are:~pleased that a large amount
of these. conditions ca.n:be accommodated in. the project. without making>ti~e-project infeasible. Those.
conditionswtiich are not acceptatile.tma~ked in redl or additionalsconditions.imposed That are.
'infeasible will erisure.that the proiect~wilt never come to fruition. VVe would liketo~note that most of
'these: conditions are not.app"ropriafe.for a;Vestin:g•Tentative Map, but recggnize~the need,to address these
.issues now in order, to ~rriove flee, project forward.
Ad~itionally,.we'request the.opportianity to verbally respond to Council's:deliberationson any added
conditions beyond kfio5e in the January'4th staff reportprior to an,y vote.taken~in the upcoming January 25,

any such condEio.n. The trade area>and store projections do not create:enough incehtive far Target
to :agree to this kind of condition, especially as many Petaluma residents already.shop-at their other
ocations inRohnert Park and. Novato. Please also recognize that between Target arid'Regency this
project,will~reguire an ihitial investment of approximately $7D million, which is:a' commitment neither
company makes°without total confidence in the-project's success.

"Grasse Crefe" parking .(approximately 1:75-spaces)-along the perimeter of the parking lot
(please see:.attached site plan).'This would add greenery to the parking field and help reduce
heat release from the parking lot. Otherwise,: Regency'cannot agree to such condition.
6. .Remove parking around'S5 and ;S8 excepf handicap spaces - As previously stated, .the•project's
parking countisalready.belowlndustry standards and.further reduction only compromises the-
success ofahe project.and its retailers: Furthermore,-the parking in_question is'vitalao.the project as
it's directly'in fr"ontiof the' main entrancesao buildings Al and M1. To rernove.parking from this area
directly im;Pacts the'viability-of these retalers,and ttie village:core, Regency; cannot agree to such
condition.

agree to this condition.

15. Incorporate recycling receptacles-Regency will incorporate additional recycling pragrams as long
as there are "sufficient.services provided by the local waste/recycling companies to su"pport such
programs.

current City municipal code allows~trucks on East. Washington..Since Johnson Drive will be a.collector
street, trucks would; also be.allowed on that street. If the; City'decides to change the municipal code to
prohibit trucks,. except'foraocal deliveries,;on Johnson D-rive ;and is in compl'ian;ce~with any and all
State laws, Regency will agree to not oppose such change as long as"truck access is available on
Lindberg Lane.
