A RESOLUTION REPEALING RESOLUTION 85-79 AND RE-APPROVING
THE ISSUANCE OF A MITIGATED NEGATIVE DECLARATION
PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY ACT
FOR THE LAKEVILLE HIGHWAY PLAN LINE
LAKEVILLE ST. /HIGHWAY - CAULFIELD LANE TO CITY LIMIT
WHEREAS, the Planning Commission has recommended the issuance of a
Mitigated Negative Declaration pursuant to the California Environmental
Quality Act (CEQA) for the following project:
The Lakeville Highway Future Right-of-Way Plan Line.
WHEREAS Resolution 85-79 mistakenly indicated a finding of significant
air quality impact,
NOW, THEREFORE BE IT RESOLVED that Resolution 85-79 is repealed
in its entirety and,
NOW, THEREFORE BE IT FURTHER RESOLVED, that the issuance of
said Mitigated Negative Declaration pursuant to the California Environmental
Quality Act is hereby approved, subject to and based on the following
findings:
1. The plan line as proposed is consistent with the Petaluma General
Plan/Environmental Design Plan;
2. The Final Study for the Lakeville Plan Line Project .adequately
evaluates the project's impact upon the environment and has been
completed in accordance with the California Environmental Quality
Act and in accordance with the Guidelines for Implementation of
said Act prescribed by the State of California Secretary of
Resources and with the Local Guidelines implementing the
California Environmental Quality Act adopted by the Council of
the City of Petaluma;
3. The Council has reviewed and considered the information in said
Final Study; and that qualified consultants have prepared the
Final Study; and the City Council has reviewed the environmental
documents applicable to the recommended project;
4. Approval of the proposed Project will have both direct and
indirect effects on the environment as identified in the Final
Study;

5. A number of proposed mitigation measures ~~hich can be
implemented to minimize environmental impacts of the proposed
Lakeville Plan Line Project have been identified in the Final
Environmental Report . At this time it is the intention of the City
Council to undertake these mitigation measures to the extent
feasible, as identified in the mitigated Negative Declaration as the
project is implemented;
6. The Final Study adequately describes alternatives to the proposed
project, as well as all significant irreversible environmental
changes which would be involved in the proposed. action should it
be implemented;
7. The Final Study adequately describes the cumulative and long
term effects of the proposed project which might adversely affect
the state of the environment.
