RESOLUTION APPROVING THE TENTATIVE SUBDIVISION MAP
FOR MAGNOLIA HILLS, A 55 UNIT (33 PARCEL) RESIDENTIAL
SUBDIVISION LOCATED ON THE NORTH SIDE OF MAGNOLIA AVENUE
BETWEEN PETALUMA BOULEVARD NORTH AND KEOKUK STREET,
AP NO's 6-450-4, 13 and 6-460-1, 6.
WHEREAS, Burbank Housing Development Corporation, as owner and
subdivider, has filed with this Council a tentative map to subdivide land
within this City to be known as Magnolia Hills Subdivision., and has paid all
required filing fees; and,
WHEREAS, the City Engineer, the Director of Planning and the Planning
Commission have examined and reviewed the same as required by law and all
reports, recommendations, and comments thereon have been forwarded to
and considered by this Council at its meeting held on June 23, 1986;
NOW, THEREFORE, BE IT RESOLVED that this Council hereby finds as
follows
Findings:
1. The proposed subdivision, together with provisions for its design and
improvement is consistent with the General Plan .
2. The proposed subdivision is compatible with the objectives, policies,
land uses and programs specified in said General Plan.
3. The gently sloping vacant site is physically suitable for the type and
pattern and density of development proposed.
4. The design of the subdivision and the proposed improvements therefore
will not cause substantial environmental damage and no substantial or
unavoidable injury will occur to fish or wildlife or their habitat.

5. The design of the subdivision and the, type of improvements will not
cause serious public health problems.
BE IT FURTHER RESOLVED, based on the findings set forth above, that
the above referred to tentative map, be and the same is hereby approved,
subject to the conditions set forth below and incorporated herein as follows:

1. The project shall conform with the following conditions of the Fire
Marshal:
a. Buildings having three or more units shall be protected by an
approved fire alarm system, see attached Section 10.307A.
b. Buildings 8,.000 ~ sq.ft. shall be protected by an approved
automatic fire extinguishing system as required by Section
10.309A of the- 1979 Uniform Fire Code.
c. Provide hydrants as shown on plan (available in pr-oject file) .
d. Provide smoke detectors with indicator light at front doors on all
units
2. A revised sepia of the Tentative Map affecting all applicable conditions
of the Tentative Map and the PUD Rezoning shall be submitted to the
Planning staff within 60 days after approval by SPARC.
3. The conditions of the City Engineer shall be conformed to as follows:
a. The developer shall comply with the amended Petaluma. Municipal
Code Section 20.36.010 and 20.3'6.020 which require the developer
to pay storm drainage impact fees (as calculated in Chapter
17.30) on construction in all secitons of the City of Petaluma.
b. The developer shall provide full half-street improvements
(including appropriate utility extensions, dedications of
right-of-way and easements) to Magnolia Avenue across the entire
frontage of the project, including the Heffner property, subject
to approval of the City Engineer.
c. Signing and striping shall conform to City of Petaluma standards.

d. The proposed public street., adjacent. to the Lieberati property
shall be built 'to City standards (e:. g. , 10' PUE, connection to
Magnolia Avenue with a minimum radius of 25! at face-of-curb,
etc.).
e. Handicapped ramps shall be provided at street corners with
pedestrian traffic.
f. All overhead utility lines and PG&E lines 12KVA or below on,
fronting or adjacent to this development shall be underground,
subject to review and approval of City Engineer.
g. Access shall be provided to the Heifner and Lieberati ,properties.
Locations to be determined at time of public improvement plans.
h. That portion of the public storm drain which is located on private
property (adjacent to the Heifner property) and continues to
Magnolia Avenue shall be installed to City standards and located
in an exclusive 10' storm drain easement or rerouted to be
included within the public street .
i. The private street. structural section shall be 2" AC layer of 5" of
aggregate base and 5" of aggregate subbase.
j. An updated soils report for this development shall be submitted at
the time the final map and improvement plans are submitted.
k. The following additional information is required for AP No.
6-450-04, Lands of Galiazzi; if not owned by the
owner-subdivider
1. Name, address and telephone number of record owner or
owners.
2. Name,, address and telephone. number and certified
authorization by owner -for subdivider to act if subdivider is
other than. record owner or owners.
1. The private driveway .and connection to Sycamore Lane shall be
designed to accommodate emergency vehicles, subject to approval
of City staff.
4. On-site drainage system shall be redesigned to include the lot
drainage. On-site and off-site drainage improvements shall be subject
to approval of the Sonoma County Water Agency and the City
Engineer .
5. The developers shall provide pedestrian sidewalks between the project
site and Petaluma Blvd. North along the north side of Magnolia
Avenue, subject to approval of City Staff.

6. To provide more convenience to the townhome owners, the garage and
uncovered parking spaces assignments shall be redesigned per staff
approval.
7. The names of the streets proposed shall be subject to approval by the
Street Naming Committee.
8. Each unit shall be provided with a lighted address easily
distinguishable from the interior streets .
