RESOLUTION OF INTENTION TO AMEND RESOLUTION OF INTENTIONI NO. 4203 N. O. S. IN THE MATTER OF THE BONDS TO BE ISSUED AND THE TERM OF THE BONDS , AND DISPOSITION OF ANY SURPLUS FUNDS , AND SETTING TIME AND PLACE FOR PUBLIC HEARING THEREON IN ASSESSMENT DISTRICT NO. 9 N. S. , CITY' OF PETALUMA, SONOMA :COUNTY , CALIFORNIA WHEREAS , Resolution of Intention No. 4203 N.C.S . , adopted on the 1st day of February, 1965 , and as subsequently amended on the 4th day of October, 1965, provides for the issuance of bonds under the provisions of the Improvement Act of 1911:; and WHEREAS , it has been determined that it is in the public i interest to issue bonds under the provisions of the Improvement I Bond Act of 1915; and ' WHEREAS , it has been similarly determined that it islin the public interest to extend the term of the bonds to be issued• from fifteen years to twenty years ; • WHEREAS , it is desired to change the provision for disposi- tion of surplus funds asiprovided in said Resolution of Intention No. 4203 N.C. S. , said surplus to be applied to the maintenance of the improvements in addition, to the pro rata crediting of assessments . NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Petaluma, Sonoma County , California, as follows: 1. It is the intention of the City Council of the City of Petaluma to delete from Resolution of Intention No. 4203 N.C.S . , as amended , the following language: "NOTICE IS; HEREBY GIVEN that serial bonds to represent unpaid assessments , and bearing interest at the rate of not to exceed six, per cent (6%) per annum, shall be issued in the manner and form provided in Part 5 , Divi- sion 7 , of the Streets and Highways Code of the State of California (Improvement Act of 1911) to represent unpaid. assessments of Fifty Dollars ($50 .00) or over, the last installment of which bonds shall mature fourteen (14) . years from the 2nd day of January next succeeding the, next September 1st following their date. Said bonds shall be and to substitute therefor the following language: "NOTICE IS HEREBY GIVEN that serial, bonds to represent unpaid assessments , and bearing interest at not more than six per cent (6%) per annum, shall be issued herein in the manner provided in Division 10 of the Streets and Highways Code:, the .Improvement Bond Act of 1915, the Ilast installment of which shall mature nineteen (19) years from the 2nd day of July next succeeding ten ,(10) months from their date. Proceedings for all work shall be taken pursuant to the Municipal, Improvement Act of 1911, and the bonds hereinabove described shall be issued-under the Improvement Bond Act of 1915 , as heretofore described. " 2 . It is the further intention of said City Council to delete from said ,Resolution of Intention No. 4203 N. C. S. , asi amended, the following language.: I ' I "BE IT FURTHER RESOLVED that if any excess shall be realized from the proceeds of assessments levied and/or bonds issued to represent the same , it shall be applied as a credit to each assessment levied pursuant to the said provisions of the Municipal '.Imprevement Act of 19.13 in proportionito the amount of each Of said assessments.." and to substitute therefor the following language: "BE IT FURTHER 'RESOLVED that if any excess shall bed realized from the proceeds of assessments• levied and/or bonds issued to represent the, same , said surplus shall be used for the maintenance of the improvement in an amount not. exceeding $ 10 , 000 . 00 , and the balance of said surplus , if any , shall be applied as a credit to each assessment levied pursuant to the said provisions of the Municipal ImprovementiAct of 1913 in proportion to the' amount of each of said assessments ." 3. NOTICE IS HEREBY GIVEN that Monday , the 7th day of February, 19.66 , at the hour of 8 :00 o' clock P.M. of said daylat the meeting place of the 'City Council of the• City of Petaluma , located in the City Hall , Petaluma , 'California , is hereby fixed by this City Council as the time and place fot hearing protests against the proposed amendment to the proceedings for Assessment District No. 9 N.S. in the matter of the bond's to be issued and the term of said• bonds, .and the disposition of surplus funds : • I HEREBY CERTIFY ,that the foregoing Resolution was duly and regularly adopted by the ;City Council of the City of Petaluma, Sonoma County, California , at a 'regular meeting thereof held on the 3rd day of January; 1966, by (the following vote, to wit: • i AYES : Councilmen .BRAINERD, CAVANAGH, JF. , COLIN, GANS , LIPMAN AND MAXOR PUTNAM.
