S. of the City of Peta-lama, California RESOLUTION DECLARING BUSINESS QPERATED FROM RESIDENCE AT 518 PARK ,LANE, PETALUMA, A PUBLIC. NUISANCE AND ORDERING SAID. NUISANCE. TO BE ABATED. WHEREAS, Mr. and Mrs. Frank Kelman reside -at 518 Park Lane, Petaluma., California; and, WHEREAS, it was' alleged by the Community Development ar_d Planning Department that said residents are conducting a business on said property, in violation of Petaluma 'Zoning Ordinance, Seotions 21-202.3 and 21-202..7 and Municipal Code Sections 11.44.120 and .6.04.050 and that said conduct constitutes a public nuisance;; and, WHEREAS, the said residents were notified of a hearing to be held on the question of whether such n-uisance did in fact exist; and, WHEREAS, said hearing was held on May 19, 1986, and evidence, both oral and documentary was heard and considered by the Council on the question of whether a p;uble nuisance did, in fact, exist at 518 Park Lane, Petaluma, and whether the cost of abating such. nuisance should be assessed against said residents; NOW, THEREFORE, BE .IT RESOLVED as follows: 1. It is found, ordered and declared that a public nuisance exists at the residence known as 518 Park Lane, Petaluma., California, and the business being conducted thereon, including the parking of a commercial fifth wheel trailer, is in violation of the above cited code sections and thereby constitutes a public nuisance. 2. The owners, Mr. and Mrs.- Frank Kelman, are hereby ordered to abate said nuisance within 30 days from the date of this resolution. Otherwise, the City Attorney of the City of Petaluma is .. ~~;,.'~ - .- hereby authorized to institute legal action to enjoin the continued performance of said public nuisance. 3. The costs o£ said abatement, including- legal costs, if not undertaken by said owners, shall be assessed against the property at 518 Park Lane, Petaluma, California, and if not promptly paid shall become a lien upon said property. 4. Copies of this resolution shall be timely served and posted in accordance the procedures specified in Petaluma Municipal Code Section 1.15.070. Under the power and .authority conferred upon this Council by the. Charter of said City.
