WAIVING SECTION 7.E. OF THE
JOINT POWERS AGREEMENT
FOR DEVELOPING AND USE OF CITY OWNED PROPERTY
FOR THE HOLDING OF A
FUNDRAISING EVENT BY THE
WAUGH INVESTMENT IN
STUDENT EXCELLENCE (WISE) FOUNDATION
WHEREAS, an agreement was developed between the City of Petaluma and the Waugh
School District to develop City owned property into a playing field adjacent to Corona Creek School;
and,
WHEREAS, the Corona Creek Athletic Field is used by the Waugh School District only
during school hours; and,
WHEREAS, the Corona Creek Athletic Field is used and operated by the City of Petaluma and
the Petaluma Community during non-school hours; and,
WHEREAS, community groups or individuals are entitled to apply to the City of Petaluma for
use of the field during non-school hours; and,
WHEREAS, a provision in the agreement stipulates, neither ®istrict nor City shall
allow the use of any alcoholic beverages or firearms on the pield Site, the
School Site ®r any property associated therewith; and,
WHEREAS, a community non-profit group would like to use the Corona Creek Athletic Field
for a fund raising event on September 27, 2003, to support the students of the Waugh School District,
which includes wine tasting.
Resolution No. 2003-154 N.C.S.
N®W, THEREFORE-, BE IT RESOLVED, that the Petaluma City Council in order to
support community non-profit groups which strive to support their schools and community, waives
Paragraph 7, section "e" of the February 8, 1996 Joint Powers Agreement for Development and Use of
City Owned Property, for the proposed September 27, 2003 event.
Under the power and authority conferred upon this Council_by the Charter of said City.
