HomeMy WebLinkAboutResolutions 86-063 N.C.S. 04/07/1986~r~ resolution No. s6-63 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE MAYOR OR CITY MANAGER TO ENTER INTO AND EXECUTE AN AGREEMENT WITH THE PETALUMA SOFTBALL ASSOCIATION BE IT RESOLVED that the Mayor or City Manager is hereby authorized to sign an agreement between the City of Petaluma and the Petaluma Softball Association to conduct the 1986 adult softball season to begin May, 1986 and to conclude August, 1986; and, BE IT FURTHER RESOLVED that a copy of said agreement is attached hereto as Exhibit "A" and made a part hereof . Mayor AGREEMEN'P BETWEEN' CITY OF PETALUMA AND SOFTBALL ASSOCIATION This Agreement between the Petaluma Parks and Recreation Department, hereafter known as. City, and the Petaluma Softball Association, hereafter referred to as the Association, entered into this Agreement on May 1, 1986, for the pu-rposes of conducting the 1986 Adult Softball leagues. These services' involve the complete operation of the season which is to begin the first week of May, 1986 and conclude .at the end of August, 1986. Specifically, the following is an outline of the responsibilities of the City and the Association. Association is acting as an independent contractor with respect to the activities conducted pursuant to the agreement . The City will: a. Provide. all bases, balls, gypsum, line markers., restrooms, storage and lights. b . Print and distribute league operations , regulations , schedules and house rules. c. Collect aI'1 .fees and distr-ibute same on a basis to the Association.. d. Provide scheduling coordination with the Association. The Association will: a. Provide and achedule two officials per game. b . Provide and schedule scorekeepers who maintain accurate game records, submit scores to the Argues-Courier, maintain. team standings and league rosters,. c. Provide personnel to properly prepare the field per City specifications . d. Handle all protests and league operations. e. Coordinate field maintenance with the. Recreation Department.. .:• The City of Petaluma on: or about April 1, 1986 will submit to the Association 90 0 of the $2:60.00 per' team. fees based on the cost of officiating, scorekeepers and grounds personnel.. At the conclusion of the season, the City then. will pay to the Association the remaining 10$ of the $260.00 team fees. All protest fees, forfeit fees or unsportsmanlike conduct fees will be collected by the Association and will remain with the Association for league operations . It is further stipulated that the Association. will assign at least one but no more than two representatives who can be contacted by the teams to answer any league open-,ation concerns.. Also,. the Association will meet once a week with the Parks and Recreation Department to coordinate the activities of the season.. The Association. will indemnify and hold City harmless from any claim or claims of liability or damages resulting from the activities of the Association conducted pursuant to this Agreement. This Agreement will. be in effect from April 1, 19.86 to the end of the season in August, 198'6.
