HomeMy WebLinkAboutResolutions 86-083 N.C.S. 04/21/1986 __, -,- ` Resolution No.86-83 N ~.5. of the City of Petaluma, California A RESOLUTION APPROVING THE ISSUANCE OF A NEGATIVE DECLARATION PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR THE EXTENSION OF BAYWOOD DRIVE RIGHT-OF-WAY ACROSS NORTHWESTERN PACIFIC RAILROAD WHEREAS, the Department of Community Development and Planning has recommended the issuance of a Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for the following project: 1. The construction of an at-grade Baywood Drive extension crossing over Northwestern Pacific Railroad tracks, as shown on SBE Map No. 853-49-16B and as more particularly described in Exhibit "A" , attached; and WHEREAS, an additional focused traffic and circulation study has been prepared for the area in and around Lakeville Highway and which has been reviewed by the Community Development and Planning Department and the City Council; and, WHEREAS, the proposed crossing will not be an inherent cause oof additional traffic but rather better service traffic generated by Shollenberger Park or the proposed marina/office complex, NOW THEREFORE BE IT RESOLVED, that the issuance of said Negative Declaration pursuant to the California Environmental Quality Act is hereby approved, based on the following findings: 1. The City Council has considered any comments and proposed mitigating measures received pertaining to issuance of said Negative Declaration, and finds the responses thereto to be adequate . 2. The project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal 86-83 Res. N.C.S. ~~ l: community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. 3. The project does not have the potential to achieve short-term, to the disadvantage of long-term, environmental goals. 4. The project does not have impacts which are individually limited, but cumulatively considerable. 5. The project does not have environmental effects which will cause substantial adverse effects on human beings either directly or indirectly . 6. The extension of Baywood Drive will provide secondary access to the proposed Petaluma Marina project. Impacts of traffic generation, effects on existing intersections, and measures to mitigate possible significant negative effects will be caused by the construction of the marina, not by this extended right-of-way and will be further discussed and considered in detail during the preparation of an environmental impact report of the entire marina project. 7. The project is in conformance with the General Plan/Environmental Design Plan.
