HomeMy WebLinkAboutResolutions 86-099 N.C.S. 05/05/1986 FZesolutiol`1 No. 86-99 N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE TENTATIVE SUBDIVISION MAP FOR VILLAGE MEADOWS, AN 81 LOT RESIDENTIAL SUBDIVISION LOCATED BETWEEN MARIA DRIVE AND ELY BOULEVARD NORTH, IMMEDIATELY NORTH OF LYNCH CREEK (A.P. NOS. 136-111-16, 20, 21, 43, 44, 45) WHEREAS, McBail Co. , as owner and subdivider, has filed with this Council a tentative map to subdivide land within this City to be known as Village Meadows Subdivsion, and has paid all required filing fees; and, WHEREAS, the City Engineer, the Director of Planning, and the Planning Commission have examined and reviewed the same as required by law and all reports, recommendations, and comments thereon have been forwarded to and considered by this Council at its meeting held on May 5, 1986; NOW, THEREFORE, BE IT RESOLVED that this Council hereby finds as follows Findings for. Tentative Map: 1. The proposed subdivision, together with provisions for its design and improvement, is consistent with the General Plan. 2. The proposed subdivision is compatible with the objectives, policies, general land uses, and programs specified in said General Plan. 3. The site is physically suitable for the type of development proposed. 4. The site is physically suitable for the proposed density of development . 5. The tentative map provides reasonable public access from a public road to that portion of the bank of the stream lying within the proposed subdivision . 6. The tentative map provides for dedication of a public easement along the portion of the bank of the stream lying within the proposed subdivision . Res. ~~...........8.6..-.9.9. w.cs. 7. 'The proposed map, subject to the following conditions complies with the requirements of Municipal Code Chapter 20:.16 and the Subdivision Map Act. BE 1T FURTHER RESOLVED, based on the findings .set forth above, that the above referred to tentative map, be and the .same is hereby approved, subject to the conditions set .for,th below and incorporated herein as follows: Conditions for Tentative= "Map': 1. Drainage design plans shall be approved . by the City Engineer and shall conform with. Sonoma County Water Agency design criteria. 2. Grading plans shall be submitted to and approved by appropriate City staff prior to issuance. of building permits for such construction. 3. Public utility access and easement locations .and widths shall be subject to approval .by PG & .E, Pacific Telephone, and the City Engineer and shall be shown on the final map as necessary. 4. All utilities as required by Code, shall be placed underground. 5. All streets in the project shall be subject to .approval by the Street Naming Committee. 6. The applicant shall. provide an irrevocable offer of dedication to the City for the portion of Lynch Creek right-of-way between the adjoining street right-of-ways or lot lines and the southeastern property line inclusive. 7. The applicant shall diligently pursue, to the satisfaction of the Director of Community Development and Planning, the acquisition and dedication to the.. City of the portions of a property containing the proposed bicycle path, in the Lynch Creek right-of-way designated on the tentative map as the property of Keokuk.. Hospitals and should that area be acquired prior to complete build-out of the project, the applicants shall provide .landscaping, irrigation systems and a pathway as shown on the development plan .. 8. The applicant shall satisfy City General Plan policies and programs with regard to providing . housing.., land in-lieu fees or alternate measures for- housing affordable to very low, low and moderate income households.. The means for satisfying- this requirement shall be developed in consultation with City staff and ratified by the City Council concurrent with final map approval. 9. During-the course of development, if archeological materials are found, all work in the vicinity of the find shall be stopped and a qualified archeologist contacted to evaluate the materials and make recommendations for mitigation as necessary, Reso. No 86-99 N.C.S. 10. The tentative map shall be revised to comply with the following requirements of the City Engineer: A. The developer shall comply with the amended Petaluma Municipal Code Sections 20.36.010 and 20.36..020 which require the developer to pay storm drainage impact fees (as calculated in Chapter 17.30) on construction in all sections of the City of Petaluma. B . Prior to complete build-out of this project, a re-evaluation of the signal need at the intersection of Rainier Avenue and Ely Blvd. North should be made. If it is determined the level of service warrants the need for the future signalization at this intersection, the developer shall agree, prior to approval of the .final map, to contribute apro-rata share based upon the ratio: Project o of traffic generated by complete build-out of the development = total estimated traffic signal warrant volume . This formula was taken from CALTRANS traffic manual and the actual numbers to be used generated from a traffic study for this development. The method of :agreement shall be determined by the City Engineer. C . The storm conduit under the half street improvements for Ely Blvd. North should be built to Sonoma County Water Agency Standards. D . The non-access easement shall be dedicated. along the entire Ely frontage (per Section 20:16.310).. E. The developer shall provide full. improvements (including appropriate utility extensions, dedications of right-of-way and easements) to Ely Blvd. across the entire frontage of project, including Stolkee and Palm properties, subject to City standards and the approval of the City Engineer. F. The typical: section for Maria Drive should include the full 28 foot half section adjacent to the tree area, as well as a taper section to approach the tree area. G. Signing and striping shall conform to City of Petaluma standards. H. The proposed street section of Ely Blvd. shall be constructed with a smooth grade and overlay on the north side if necessary. I. The .sanitary sewer located between Lots 44 and 45 and 4 and 5 shall be in an exclusive, dedicated 10' paved easement with adequate .clearance from adjacent• structures or overhangs to allow accessibility (minimum 10') . Reso No 86-99. ~~ J. The overhead utility lines along Ely Blvd. shall be undergrounded per Petaluma Municipal Code 20..32.330 Undergrounding Requirements. 11. A payback agreement or other arrangement shall be executed for repayment to the developers for improvements in Ely Blvd. upon development of benefited neighboring properties, agreement subject to staff approval. 12. The applicant is notified that the project site is in the Bernard Eldredge attendance area of the Old Adobe School District and is therefore subject to School Facility Fees which are presently $l, 512.00 per unit. 13. The applicant is advised that the development may be subject to future charges for a public improvement benefit district pursuant to Chapter 13.34 of the Petaluma Municipal Code in order to provide needed future improvements to Rainier Avenue and/or the proposed Rainier Avenue overpass which will serve the project area. 14. This project shall be subject to payment of storm drainage impact fees.
