HomeMy WebLinkAboutResolutions 86-100 N.C.S. 05/05/1986 Resoluti®n NO.86-loo N.C.S. of the City of Petaluma, California A RESOLUTION APPROVING THE ISSUANCE OF A NEGATIVE DECLARATION PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR THE EXTENSION RIGHT-OF-WAY ACROSS NORTHWESTERN PACIFIC RAILROAD FOR A NEW PROPOSED STREET WEST FROM MCDOWELL BLVD . NORTH BETWEEN CAPRI AND PETALUMA ESTATES MOBILE HOME PARKS WHEREAS, the Department of Community Development and Planning has recommended the issuance of a Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for the following project: 1. The construction of an at-grade crossing over Northwestern Pacific Railroad tracks, as shown on SBE Map No. 853-49-3 and as more particularly described in Exhibit "A" , attached; and WHEREAS, a focused traffic and circulation study has been prepared for the area in and around McDowell Blvd. North and which .has been reviewed by the Community Development and Planning Department, which shows that traffic impacts generated by the industrial subdivision which will be accessed over this crossing will be mitigatible by signalization of intersections; and, WHEREAS, the proposed crossing will not be an inherent cause of additional traffic but rather service traffic generated by the proposed South Point Industrial Park, NOW THEREFORE BE IT RESOLVED, that the issuance of said Negative Declaration pursuant to the California Environmental Quality Act is hereby approved, based on the following findings: 1. The City Council has considered any comments and proposed mitigating measures received pertaining. to issuance of said Negative Declaration, and finds the responses thereto to be adequate. 86-100 Rcs. The project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. 3. The project does not have the potential to achieve short-term, to the disadvantage of long-term, environmental goals. 4. The project does not have impacts which are individually limited, but cumulatively considerable, 5. The project does not have environmental effects which will cause substantial adverse effects on human beings either directly or indirectly . 6. The creation of a new access road will provide access to the proposed industrial subdivision. Impacts of traffic generation, effects on existing intersections, and measures to mitigate possible significant negative effects caused by the construction of the Industrial Park, are considered in a traffic study for the project and will be further discussed and considered in detail during the Planning Commission and City Council review of the entire project . 7. The project is in conformance with the General Plan/Environmental U~rslpo~nd authority conferred upon this Council by the Charter of said City.
