HomeMy WebLinkAboutResolutions 86-044 N.C.S. 02/24/1986 F E a 1 s X986 ~ Resolution No. 86-44 NC.S. of the City of Petaluma, California A RESOLUTION UPHOLDING APPEAL OF PLANNING COMMISSION DECISION TO INCORPORATE SKY PARK ESTATES INTO EAST OF ELY SUBSEQUENT EIR AND APPROVING THE ISSUANCE OF A NEGATIVE DECLARATION PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR THE PROPOSED SKY PARK ESTATES, A 20 LOT SUB- DIVISION IN THE VICINITY OF GARFIELD DRIVE. WHEREAS, on January 14, 1986 the Planning Commission recommended the incorporation of the proposed Sky Park Estates Subdivision into the East of Ely Subsequent EIR; and WHEREAS, thereafter on January 23, 1986 an appeal of said action was filed to the City Council, the matter being heard on February 3, 1986; Whereas, both written and oral evidence was duly presented at said hearing ; NOW, THEREFORE, BE IT RESOLVED the City Council hereby upholds the appeal; and issuance of said Negative Delcaration pursuant to the California Environmental Quality Act is hereby approved based upon the following findings; 1. The project as conditionally approved does not have the potential to substantially degrade the quality of the environment, substantially reduce the habitat of fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten or eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal, or eliminate important examples of the major periods of California history or prehistory. 2. The project as conditionally approved does not have the potential to achieve short-term environmental goals to the disadvantage of long-term environmental goals. 86-44 Res. No . .:............................ N.C.S. 3. The project as conditionally approved does not have possible environmental effects which are individually limited but cumulatively considerable. 4. The environmental effects of this project as conditionally approved will not cause substantial adverse effects on human beings, either directly or indirectly. 5. Potentially adverse impacts will be mitigated by the incorporation of design standards relative to noise mitigation, drainage and minimum water pressure standards as set forth in detail through tentative map conditions . Under the power and. authority conferred upon this Council by the Charter of said City.
