HomeMy WebLinkAboutResolution 2003-144 N.C.S. 07/14/2003~s®r~~~l®~ N®. 2003-144 ~.~.s. of the City of Petaluma, California RESOLUTION DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS OF THE BALLOT MEASURES TO BE VOTED ON AT THE NOVEMBER 4, 2003 SPECIAL ELECTION REGARDING A UTILITY USERS TAX WHEREAS,. the City Council of the City of Municipal Election to be held on November 4, 2003, voters the following questions which read as follows: Charter Amendment Petaluma has called a Special for the purpose of submitting to the Shall the City of Petaluma Charter be amended to allow for the adoption of a special utility users tax on gas and electric service for 20 years, at a rate of no more than five percent (5%) of the monthly charge for the service, to pay for curb-to-curb repair and reconstruction of existing City Streets and not for the construction of new streets? Companion Measure Shall a special tax be approved on users of gas and electric service for 20 years, at a rate of no more than five percent (5%) of the monthly charge of the service, with an annual cap for non-residential users and an exemption for service users who participate in PG&E's CARE program, to pay for curb-to-curb repair and reconstruction of existing City streets and not for the construction of new streets? NOW, THEREFORE, BE IT RESOLVED, ORDERED, AND DECLARED AS FOLLOWS: The City Clerk is directed to transmit a copy of the measures set forth in the recital hereto to the City Attorney. Resolution No. 2003-144 N.C.S. Page 1 2. The City Attorney is directed to prepare an impartial analysis of the measures as provided in Section 9280 of the Election Code of the State of California. The impartial analysis shall be filed with the City Clerk by August l , 2003; the date fixed by the City Clerk as the deadline for submitted said material.
