HomeMy WebLinkAboutResolution 2003-143 N.C.S. 07/14/2003~~so~,~~ri®~v N®. 2003-143 c.c.s. ®~ ~~ C~T~ ®~ ~ETAI.~TIVIA' CALIF®I~I~dIA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA, CALIFORNIA, PROVIDING FOR THE FILING OF ARGUMENTS FOR AND AGAINST CITY MEASURES SUBMITTED AT THE NOVEMBER 4, 2003 SPECIAL ELECTION WHEREAS, §9219 of the Elections Code of the State of California authorizes the City Council, by majority vote, to adopt provisions to provide for the filing of arguments for and against city measures submitted at municipal elections; and WHEREAS, the City Council of the City of Petaluma has called a Special Election to be held November 4, 2003, for the consideration of a Charter amendment and a companion measure to be placed before the voters; and WHEREAS, the measures to be voted upon at the Special Election are as follows: Charter Amendment Shall the City of Petaluma Charter be amended to allow for the adoption of a special utility users tax on gas and electric service for 20 years, at a rate of no more than five percent (5%) of the monthly charge for the service, to pay for curb-to-curb repair and reconstruction of existing City Streets and not for the construction of new streets? Companion Measure Shall a special tax be approved on users of gas and electric service for 20 years, at a rate of no more than five percent (5%) of the monthly charge of the service, with an annual cap for non-residential users and an exemption for service users who participate in PG&E's CARE program, to pay for curb-to-curb repair and reconstruction of existing City streets and not for the construction of new streets? Resolution No. 2003-143 N.C.S. Page 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PETALUMA, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to Section 9282 of the Elections Code of the State of California, each argument submitted for or against the above measures shall not exceed 300 words in Length, and shall be printed upon the same sheet of paper and mailed to each voter with the sample ballot for the election. SECTION 2. The following appropriate heading shall precede the arguments' wording but shall not be counted in the 300-word maximum: "Argument in support of Measure _." or "Argument against Measure _." SECTION 3. Printed arguments submitted to voters in accordance with Section 9282 of the Elections Code shall be filed with the City Clerk, accompanied by the printed name(s) and signature(s) of the person(s) submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed name and signature of at least one of its principal officers. SECTION 4. Said arguments for or against the measures are due in the Office of the City Clerk prior to 5:00 p.m. on Monday, August 18, 2003.
