HomeMy WebLinkAboutResolution 2010-047 N.C.S. 04/05/2010Resolution No. 2010-047 N.C.S. of the City of Petaluma, California APPROVING THE PROJECT BUDGET AND AUTI-IORIZING THE AWARI) OF CONTRACT FOR THE R~C'~'CLED WATER BOOST'ER PUIVIP NO. 2 IMPROVEMEN'TS PROJECT PROJECT NO. C00500908 W~IER~AS, City staff has prepared construction bid documents and advertised for construction of this Project; and, WI~EREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and, WHEREAS, the project was bid on January 21, 2010, and three (3) bids were received and opened on February 24, 2010 in accordance with applicable law; and, WHEREAS, the lowest bid for the Project was submitted by Cal Electric from Fairfield, CA for $62,800; and, WHEREAS, staff has determined that Cal Electric's bid satisfies the bidding requirements for the Project; and, WHEREAS, staff has verified that Cal Electric possesses a valid California Contractor's License, Class G10, number 848900 that qualifies Cal Electric to perform the Project; and, WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ("CEQA~") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15302, because the project consists of replacement of existing electrical ec~uipment and motor control systems for the City's existing Recycled Water Booster Pump Station No. 2~ with no expansion of capacity. NOW, TH~REFORE, BE IT RESOLVED that the City Council of the City hereby: 1. Approves the Project Budget ira the amount of $279,748. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non-conformance in the bid of Cal Electric for the Recycled Water Booster Pump Station No. 2 Improvements Project, finds the bid of $62,800 to be the lowest, responsive bid and further finds that Cal Electric is the lowest responsible bidder. 3. Awards the contract for the Cal Electric for the Recycled Water Booster Pump Station No. 2 Improvements Project to Cal Electric, in the amount of $62,800, the amount of the lowest responsive bid, conditioned on Cal Electric's timely executing the project contract and submitting all required documents, including but not limited Resolution No. 2010-047 N.C.S. Page 1 to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. The City Manager and/or his designee is hereby authorized to execute on behalf of the City of Petaluma amendments to the contract, so long as such amendments in the aggregate do not increase the original contract not-to-exceed amount by more than $25,000. 5. Directs staff to issue a notice of award to Cal Electric. 6. Authorizes and directs the City Manager to execute the project ~contract on behalf of the City of Petaluma upon timely submission by Cal Electric of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
