HomeMy WebLinkAboutResolution 2008-098 N.C.S. 06/02/2008Resolution No. 2008-098 N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE PROJECT BUDGET, REJECTING THE BID PROTEST, AND AUTHORIZING THE AWARD OF CONTRACT FOR THE WASHINGTON STREET 16-INCH WATER MAIN AND SEWER CIPP PROJECT PROJECT NO. 000501008-30600-54151 WHEREAS, City staff has worked diligently to prepare construction bid documents and advertise for construction of this Project; and WHEREAS, in accordance with California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the project was bid on May 1, 2008, and five (5) bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for the Project was submitted by Team Ghilotti, Inc. ("Team Ghilotti") for $1,049,189.12; and WHEREAS, staff has verified that Team Ghilotti possesses a valid California Contractor's License, Class A, license number 895384, that qualifies Team Ghilotti to perform the Project; and WHEREAS, on May 16, 2008 the City received a letter from Ghilotti Construction Company, Inc., protesting against the award of the Project to Team Ghilotti; and WHEREAS, on May 21, 2008 the City received a letter from Team Ghilotti, Inc., in response to the protest; and WHEREAS, City staff and the City Attorney's office have reviewed the protest, determined it to be without merit, and recommend that the protest be rejected; WHEREAS, the Project is exempt from the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301, subparagraphs (b) and (d), and Section 15302 subparagraph (c), of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the Project involves repair and maintenance of existing public structures and facilities involving negligible or no expansion of use of publicly owned utilities to provide sewerage services, and restoration or rehabilitation of deteriorated or damaged structures or facilities to meet current standards of public health and safety, and replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, including replacement or reconstruction of existing utility systems and facilities involving negligible or no expansion of capacity. Resolution No. 2008-098 N.C.S. Page 1 NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby: Approves the Project Budget in the amount of $1,460;000. 2. In accordance with applicable law, the City Council of the City of Petaluma hereby finds that the protest concerning award of the Project submitted by Ghilotti Construction Company, Inc. is without merit in accordance with the analysis of City staff and the City Attorney's office. Accordingly, the protest submitted by Ghilotti Construction Company, Inc., is hereby rejected. In accordance with California Public Contact Code Section 20162 and other applicable law, waives any and all non-conformance in the bid of Team Ghilotti for the Washington Street 16-inch Water Main and Sewer CIPP Project, and finds the bid of $1,049,189.12 to be the lowest, responsible bid. 4. Awards the contract for the Washington Street 16-inch Water Main and Sewer CIPP Project to Team Ghilotti, in the amount of $1,049,189.12, the amount of the lowest responsible bid, conditioned on Team Ghilotti's timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. Directs staff to issue a notice of award to Team Ghilotti. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Team Ghilotti of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. Under the power and authority conferred upon this Council by the Charter of said City.
