HomeMy WebLinkAboutResolution 2003-105 N.C.S. 06/02/2003resolution No.2003-105N.C.S. of the City of Petaluma, California ADOPTING THE CENTRAL PETALUMA SPECIFIC PLAN AND AMENDING THE 1987-2005 PETALUMA GENERAL PLAN TO INCORPORATE BY REFERENCE THE SPECIFIC PLAN TEXT AND MAPS WHEREAS, in 1996, the City Council directed that a specific plan be prepared for the 400 acre area bounded by Lakeville Street, Petaluma Boulevard, the Petaluma River and US Highway 101; and, WHEREAS, the Central Petaluma Specific Plan process encouraged the participation of interested and affected landowners, development interests, business owners and citizens through the creation of a Citizens Advisory Committee and numerous public meetings at various stages in the preparation of the plan; and, WHEREAS, the Central Petaluma Specific Plan establishes new land use designations and corresponding definitions, as well as goals and policies in the areas of land use, community design, public space and river access, circulation, flooding and noise, utilities and public services and historic preservation that are consistent with the goals, policies and programs of the 1987-2005 Petaluma General Plan; and, WHEREAS, the Central Petaluma Specific Plan was prepared in accordance with Government Code Section 65450 et. seq.; and, WHEREAS, the potential environmental impacts of the Central Petaluma Specific Plan have been considered, and proper action has been taken by the City Council in compliance with the California Environmental Quality Act (CEQA) and local governmental guidelines in that a Final Environmental Impact Report (Final EIR) has been certified by adoption of a separate resolution; and, WHEREAS, the Planning Commission held duly noticed public hearings on the Central Petaluma Specific Plan on March 11, 2003 and March 25, 2003, and the Historic and Cultural Preservation Committee (Historic SPARC) held duly noticed public hearings on the plan on February 27, 2003 and March 27, 2003; and, W1=IEREAS, the City Council held duly noticed public hearings on the Central Petaluma Specific Plan on April 21, 2003 and May S, 2003 before rendering its decision. NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby adopts the Central Petaluma Specific Plan with all approved modifications, based on evidence and testimony in the record, and amends the 1987-2005 Petaluma General Resolution No. 2003-105 N.C.s. ~~ Plan to incorporate by reference the adopted Specific Plan text and maps, based on the following findings: 1. That the Central Petaluma Specific Plan includes text and diagrams, as required by Section 65451. (a)(1-4) and 65451(b) of the Government Code addressing the distribution, location, extent and intensity of the uses of land, major components of public and private infrastructure, standards and criteria by which development will proceed, and implementation measures. 2. That the Specific Plan is deemed to be in the public interest to provide for orderly development within the designated plan boundaries. 3. That the Specific Plan is consistent and compatible with the rest of the General Plan and any implementation programs that may be affected, and will further the objectives, policies and programs of the General Plan. 4. The potential impacts of development in accordance with the Specific Plan have been assessed and have been determined not to be detrimental to the public health, safety, or welfare. 5. That the Specific Plan has been processed in accordance with the applicable provisions of the California Government Code and the California Environmental Quality Act. The requirements of the California Environmental Quality Act (CEQA) have been satisfied through the preparation of a Final Environmental Impact Report (FEIR), which analyzed the potential environmental impacts of'the Specific Plan, and represents an adequate documentation of the environmental implications and possible mitigation measures of the proposed project for use in decision-making. The City Council has made written findings for each significant impact, which are supported by substantial evidence in the record, and all feasible mitigation measures, as identified in the Final EIR prepared for the Central Petaluma Specific Plan are herein incorporated into the project.
