HomeMy WebLinkAboutStaff Report 3.H 1/6/2014 A Ite4vw#3 .H L U4t voLiliA ;ao 7858 DATE: January, 6,2014 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Scott Brodhun,Assistant City Manager Lena Cox, Environmental Services Supervisor SUBJECT: Resolution in Support of Request by Petaluma Wetlands Alliance to Submit an Application Seeking to Enroll Petaluma's Wetlands in the San Francisco Bay Estuary Ramsar Wetlands of International Importance RECOMMENDATION It is recommended that the City Council approve the attached Resolution Authorizing an Application to San Francisco Bay Joint Venture(SFBJV) Seeking to Enroll Certain City of Petaluma Wetlands Properties in the San Francisco Bay Estuary Ramsar Wetlands of International Importance. BACKGROUND The Convention on Wetlands of International Importance, known as the Ramsar Convention, convened first in 1971 and an intergovernmental treaty was adopted. The United States joined the Convention in 1987. Central to the Treaty, which is non-regulatory with voluntary participation, is the mission of conservation and wise use of all wetlands. The San Francisco Bay Joint Venture (SFBJV) is the largest bay area partnership devoted to protecting wetlands. In February 2013,the San Francisco Bay Estuary was added to the Ramsar International Convention on Wetlands. SFBJV coordinates the San Francisco Bay Ramsar site, including the submissions for inclusion in the Ramsar Designation. A map of the San Francisco Bay Ramsar site and listing of participating agencies is attachment 6 to this report and of particular note are 3 sites (ID 13, 42 & 110) held by State Fish and Game, the State Lands Commission and Sonoma Land Trust that are described as Petaluma River Marsh. There are also various properties included that are under the jurisdiction of nearby local government entities and the Sonoma County Water Agency. The Petaluma Wetlands Alliance (PWA) has proposed that the City of Petaluma apply for designation of its wetlands as part of the San Francisco Bay designation. Application would be submitted to SFBJV, who have encouraged the submittal. Agenda Revie City Attorney Finance Director City Manager DISCUSSION The goal of Ramsar is the protection and wise use of wetlands. There are no regulatory requirements,just a good-faith commitment to manage wetlands for conservation purposes. The City of Petaluma's wetland properties are in the northernmost area of tidal marsh and wetlands for the San Francisco Bay. The areas proposed for Ramsar Designation are already publically protected lands and several are also subject to conservation or open space easements held by entities such as the Sonoma County Agricultural, Preservation and Open Space District (SCAPOSD), or State Fish and Game. The parcels intended for inclusion are as follows: Alman Marsh Tidal Wetlands—Identified in Attachment 2 as; 005-060-075 & 76 Alman Marsh was acquired by the City utilizing Sonoma County Agricultural Preservation and Open Space District funding. A Conservation Easement and Agreement was executed between the City and Open Space District at the time of acquisition,the purpose of which is to preserve the open space, scenic, habitat, natural resource, and recreational values of the Property and to prevent any uses of the Property that will significantly impair or interfere with those values. In accordance with the Conservation Easement,the uses of the property are confined to passive recreational activities and improvements associated with such; habitat restoration and enhancement; and, management and conservation of natural resources. Shollenberger Park Wetlands—Identified in Attachment 2 as; 017-170-001 The City and the California Department of Fish and Game entered into an agreement in 1975 for use of the Shollenberger property as a dredge spoils site and for preservation of wildlife habitat. The Deed Restriction covering the site assures that the property be devoted to open space use, but does not preclude the area's ongoing use as a dredge spoils disposal site. The City has developed a draft management, maintenance and monitoring plan and is currently working to obtain approval from the U.S. Fish and Wildlife Service to implement the plan in order to dispose of dredge spoils at the site and to assure protection of the salt marsh harvest mouse habitat and wise use of the community's asset. Gray's Marsh Wetlands—Identified in Attachment 2 as; 068-010-034 This was a grant funded acquisition and is subject to a Conservation Easement agreement between the City and Open Space District. The acquisition was completed in order to conduct wetlands restoration, habitat enhancement, water treatment and low intensity public outdoor recreation. The purpose of the Conservation Easement is to preserve the natural, scenic and recreational values of the property and to prevent any uses of the property that will significantly impair or interfere with said values. Wasterwater Treatment Wetlands—Identified in Attachment 2 as; 068-010-025 This parcel was purchased by the City in 1972 to construct the oxidation ponds that were also built in 1972 and remain in use. The parcel includes jurisdictional wetlands, designated as such during the permitting process to construct the wastewater treatment facility, and a portion of Ellis Creek and the oxidation ponds, all of which support many bird species. Jurisdictional Wetlands are regulated by the U.S. Army Corps of Engineers under Section 404 of the Clean Water Act. 2 Hill Property Tidal Marsh —Identified in Attachment 2 as; 019-330-009 This parcel was purchased by the City in 2004 for Open Space. A City Council Resolution designated the property Open Space and expressed the City's intention to preserve and protect the existing habitat and wildlife species on the site. The Ramsar designation is largely honorary and the benefits include the prestige of being part of the largest California Ramsar site; widespread recognition of the importance of Petaluma's wetlands; and, support and assistance in fundraising and grant procurement. SFBJV coordinates the SF Bay Ramsar site and have indicated their desire to include Petaluma's application in their annual report, due the first quarter of 2014. There is no fee associated with the application, and as mentioned designation is non-regulatory and completely voluntary. If accepted, the City is agreeing that the areas enrolled will be for the protection and wise use of wetlands, obligations the City has already agreed to and complied with through the various Conservation Easements and commitments previously in place. If accepted, the City will also have the ability to add to, delete or reduce a site should unforeseen changes in use occur. Human made wetlands are eligible, and this category in the application specifies wastewater treatment areas; oxidation basins. As well, continued use of Shollenberger as a dredge spoils site is not impacted, as the activity is beneficial to the wetlands, marshes and wildlife at the site. Submission of the request for inclusion to the SF Bay Joint Venture will lead to designation as wetlands of international significance as part of the SF Bay designation. Such an action by the City of Petaluma will support awareness and understanding of the exceptional natural resources in the community and the connection to the SF Bay Estuary. The action requested by the PWA, to apply for designation, is consistent with commitments Petaluma has previously made, and supports the activity of the PWA. The proposed areas are among the community's most cherished public properties, have significant visitation from out of the area guests, provide educational opportunities for over 600 students annually, and support numerous federally threatened and endangered species as well as thousands of migratory birds annually. The Recreation, Music and Parks Commission considered the item at their regular meeting in November, and recommends City Council approval of the resolution. City staff and representatives of the PWA will be available to respond to questions. FINANCIAL IMPACTS There is no cost for submission of the application, and PWA will provide the support necessary to apply. Successful designation may increase visitation to Petaluma, adding to the City's tourism economy, however such a benefit is speculative and benefits unknown at this time. ATTACHMENTS 1. Resolution 2. Based in Petaluma,our 140 scientists work from the Sierra to conserve nature from wildlife and people through science, partnerships and outreach. The Petaluma River's marshes and wetlands are ecologically important sites that provide key habitat for a broad suite of species and a range of ecological services. Together,the proposed sites provide critical habitat for the Endangered California Clapper Rail,and thousands of migratory waterfowl, shorebirds and other bird species of special concern. Point Blue has shown that Petaluma marshes are among the most likely to survive future sea-level rise. They have also been identified as conservation hotspots within the San Francisco Bay Estuary due their greater resilience to sea-level rise and high bird diversity. These results have been published and are available online at www.prbo.org/sfbayslr and in scientific journals(Veloz et al. 2013 http://www.esaiournals.org/doi/abs/10.1890/ES12-00341.1#n102 and Stralberg et al 2011 www.plosone.org/article/info%3Adoi%2F10.1371%2Fiournal.pone.0027388). A Ramsar designation will help protect these marshes and wetlands was well as their critical role in linking other wetlands along the Petaluma River to the San Francisco Bay Estuary. These linkages are vital to the functioning of our estuary as a whole and to the ability of species to survive in a changing climate. This recognition will help protect these sites into the future. As a neighbor to the proposed wetlands,we are pleased to learn of this submission and hope that the unique features of the Petaluma wetlands and marsh properties will be supported by this voluntary, prestigious, international designation.
