regular meeting of the City Council of the City of Petaluma on the 6th day of March,
1961.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PETALUMA:
1. That, pursuant to the provisions of the Annexation of Uninhabited Territory
Act of 1939, a petition signed by owners of not less than one-fourth of the land in the
hereinafter described territory, by area and by assessed value as shown on. the last
equalized assessment roll of the County of Sonoma, was filed with the Council
of the City of Petaluma on February 20th, 1961, requesting annexation of the hereinafter
described territory to said City.
2. That the territory which the petitioner requests be annexed to the City of
Petaluma and which said City and its Council propose to:annex, is situate in the County
of Sonoma, State of California, hereby designated "Novak Annexation No. 5, " and
described as follows:
Beginning on the northwesterly property line of East Washington Street,
said point being the northeasterly corner of Novak Annexation No. 3 as
established by Ordinance No. 397 N.C.S. of the City of Petaluma on July 11,
• 1955; thence N 35° 36' E along the northwesterly property line of E. Wash-
ington Street 406..56 ft. to a point; thence N' 54° 37' 10" W 979. 46 feet to a
point; thence S 35° 23' 20" W 406. 56 feet to the northerly line of the afore-
mentioned Novak Annexation No, 3; thence .S 54° 37' 10" E along the afore-
mentioned Novak Annexation No. 3 line 977,96, ft. to the point of beginning.
Containing 9, 13 'acres..
3. That the County Boundary Commission of Sonoma County, California., did
in session duly assembled on Tuesday, February 7th, 1961, consider the proposed
annexation boundaries of said "Novak Annexation;No. 5; " as above described, and
as submitted to said Commission,by the, proponents of .said.annexation,
40. That.Monday; April 17th,, `1961; at the hour of 7:30 pe. m.., in the
Council Chambers in. the City Hall in the City of Petaluma, County of Sonoma,
California, is hereby fixed as the time and place when and where any person
owning real property within the uninhabited territory':above described and proposed
to be annexed to the City of Petaluma, and having any objections to the proposed
annexation, may appear before the Council of the 'City of,Petaluma and show cause
why such uninhabited territory should not be so annexed:to the City of Petaluma,
The protest must be in writing, may be filed at any time before the hour set for
the hearing objections to the proposed annexation, and shall state the name or
names of the owner or owners of property affected and the description and area
of such property; in general terms,
5, The City Clerk of the.City of Petaluma is hereby authorized and
directed to cause a copy of this, to be published at least twice, but
not oftener than once a'week, in the Argus' - Courier; a newspaper of general
circulation published in said City of Petaluma, the city to which it is proposed to
annex the aforesaid territory, said publication to be complete at least twenty (20)
days prior to the date set for hearing,
6, In the event there is, upon the land proposed to be annexed to said
City, a structural improvement owned, being acquired or leased by a county fire
protection district, the City Clerk is directed to cause'written notice of such pro-
posed annexation to be mailed to the governing body of such district, such notice
to be sent not less than ten (10) days before the first'public hearing upon such
proposed annexation,
7, The City Clerk is directed to cause written notice to be given to such
other persons as may be legally entitled thereto, in the manner required by law,
I hereby certify that the foregoing resolution was duly and regularly
introduced and adopted by the Council of the City of Petaluma, on the
• 6th day of March, 1961, by the following vote:
