MKPeraXYOLVEIXVIKIX WHEREAS,....the..City.Planning Conartassian..has-cle-termined.that the final map of Novak Subdivision No. 4 conforms with the tentative imp of said sub.- division, and said Planning Commission has approved said final rnap.,...anihas..cartifieci such approval to the City Council, and has recommended that said tuap_b_e_approved.by the City Council; and . WHEREAS, the. City Engineer approved, said final map and his certificate of approval has, been set forth thereon; and WHEREAS, the Council has reviewed anicansidexad_said final map, the plan of subdivision, and the offers of dedication shown thereon, and has.sleter- mined to approve the same, subject to the execution, of.an..agree.ment.„. and.the furnishing. of a bond to secure performance thereof coveringimpromehieuts on.and_in_the_vicinity of said, subdivision, as hereafter providet . NOVV., THE.REFORE,....13E.I.T..RESOLVED-THATsaid finat.map--Qf Novak Subdivision No 4. beiand the same is hereby approved,. _subject. howevex,...to the following conditions and exception; to wit; That the dedication of the streets on said final map shall not be accepted by the City, unless and until the subdivider and owner makes, executes and delivers an agreement to and with the City of Petaluma containing the bilowingterms....conditioas..an.d..co.v.enants, to wit: (1) The subdivider and owner will do, perform and complete the followingimproye7 ment work: (a) Construct curbs, gutters, and sidewalks on all streets within the subject subdivision. (b) Construct 2'4 plant mix surfacing..over 8.',1..uutreatethroetbase_with fog_sen1, 40 ft. width between curbs on Ea.st..Madison.Street..and..L.auren_ariv.a.within the subject subdivision, (c) Construct 2 plant mix surfaciag..0.1er 8" untreated.rock..base..with.fog..seal, 36 ft. width between, curbs on Leland Drive within the subject subdivision. - 1 - /4-277..f (d), Construct 2" plant mix surfacing;over 6" untreated rock base with fog seal, 30 ft, width between curb on Robert(Court within the subject subdivision, (e) Construct storm drainage system, consisting of valley gutters, catch basins, and storm sewer mains to serve the subject subdivision in accordance with the requirements of the City Engineer. (f) Construct sanitary sewer system to serve all lots within the subject sub- division in accordance with the requirements of the City Engineer, The sanitary sewer shall be extended to the subdivision boundary on all stub streets, (g) Construct a water system to serve all lots within the subject subdivision in accordance with the requirements of the Petaluma Water Department and City Engineer, The water main shall be extended to the subdivision boundary on all stub streets, (h) Fire hydrants and an -alarm system shall be installed in accordance with the requirements of the Fire Chief, City of Petaluma, (i) Survey monuments shall be installed at the center line intersection of all streets and at the radius point of all cul-de-sacs within the subject sub- division. (j) Street and traffic regulatory signs shall be installed in accordance with the requirements of the City Engineer, (k) The drainage channel at the rear of Lots 1 through 6 and adjacent to East Washington Street shall be realigned, cleaned and cleared of all obstruc- tions. (1) A 6 ft, high rigid fence of approved design shall be constructed along the rear of Lots 1 through 6, (m) All;improvements shall be constructed to the standards of the Department of Public Works, City of Petaluma, and in accordance with the plan sub- mitted by the subdivider entitled, ""Improvement Plans for Novak No. 4 in - 2 - l the City of Petaluma, California, " consisting of one sheet, as approved by the'City Engineer _ 2;_ The,subdivider shall reimburse the City. of Petaluma,for inspection at the rate of $4a 25 per hour, plus the actual cost of tests performed by testing laboratories,,. 3, The subdivider and owner' shall furnish the City with a performance bond in the sum of ninety thousand and no/100 dollars ($90, 000, 00)_, to be issued by a surety corp- oration approved by the City Manager,._.guaranteeing the performance of the subdivider and • owner..of..all.work.by.doe._subd.ivider._and,owner herein. 4 The said subdivider and.owner shall also file with the City a Maintenance Bond in. the sum of thirty thousand and no/100 dollars ($30, 000. 00), to be issued by a surety corporation approved by the City Manager, after the completion of said work, and as a condition for the release of said performance bond, which said maintenance bond shall continue in force and effect for a period of one (1):year,:__. _ NOW, THEREFORE, BE IT RESOLVED THAT upon the execution of said agreement in the form. approved by the City Attorney, the,furnishing;of said performance bond, approved as to form by the City Attorney and as to sufficiency by the City Manager, the City Clerk and Mayor be and they are hereby authorized and directed to sign the certificate'on said final map certifying that the City Council has approved the. same and accepted all'the streets thereon, under the power' ad'authority conferred upon this Council by the Charter/of..said.City. / / . .
