HomeMy WebLinkAboutStaff Report 4.A 3/17/2014 esb'L Lv:>r W9 R lase DATE: March 17, 2014 TO: Honorable Mayor'and,Members of the City Council through City Manager FROM: Dan.St.John, : rector, Public Works and Utilities Larry Zimmer, P:E. —Manager, Capital Projects SUBJECT: Resolution Approving the Project Budget and Authorizing Award of Contract for the Wiseman Park Restroom Project RECOMMENDATION • Staff recommends that the.City.Councilapprove the project budget and authorize the award of contract for the Wiseman Park Restroom Project. BACKGROUND This project consists of building a restroom in an undeveloped area located betweeri.the soccer fields-and softball diamonds near the south end of Wiseman Park facing St. Augustine Circle. The,project has been long identified:by the youth sports,advocates.and City staff as a necessary improvement to enhance the park and provide adequate sanitary,facilities to the many soccer and softball�players and spectatorsthat regularly use the park. The.existing "port-a-potty" is not adequate. Work will include site;;grading, demolition, constructing curb ramps, striping, bollards, water service:connection sewer`lateral connection, excavation, erosion control, installation of new facilities including.a City furnished pre-manufactured huilding'with accessories, building slab, plumbing, equipment, and maintenance road which will also serve as an ADA compliant pathway. Basedsninputreceived:at:public meetings held in March and April 2013, staff changed the project design and setthe building back from the street than originally planned. Other changes`requested at public meeting include adding exterior lighting forsecurityaand landscaping to help,the building blend into,the park setting. These two:items:will be completed by Parks staffwhenfundingbecomes available rather than`under this contract'because it can be done more cost effectively::Representatives of various sports'leagues strongly supported the need for a restroom`because of the;many hundreds of participants and spectators using the sports fields, including therPetaluma Girls Softball League, Petaluma Youth Soccer League, Lacrosse and various;adiilt soccer teams. On;May6, 2012', Council authorized staff to prepare plans and speeificationsiand`to advertise for construction of the project The proposedaction meets Council Goal'"Plan for and implement priority capital projects as finding permits". DISCUSSION Staff issued a Notice Inviting Bids on January 9, 2014. Petaluma $167,265 Engineer's estimate N/A $ 75,000 • Council:previously approved•,a;total project budget of$100,000, comprising $80,000 of Park Land'ImpactFees and $10,000 in donations each from the Petaluma Youth Soccer League (PYSL) and_Petaluma Girls Softball•Association (PGSA). Staff recommendsCity Council authorize the City Manager to enter-into contract for the Wiseman Park Restroom Project with the apparent low bidder,.Cats 4 U, Inc. Construction is tentatively scheduled,to begin in April 2014, and is expected to last approximately thirty working days. FINANCIAL'IMPACTS The proposed action will'.requ„ire,an additional$40,000 funding from the Park Land Impact Fee account. The change will have no impact on the General Fund. The project budget as summarized in the table below exceedsthe May 6, 2013 staff estimate by $40,000 for the following reasons: • 2 1. Additional costs for thelbuilding purchase due to required building code revisions. 2. Design changes and additions based on.public inpui and Parks Commission recommendations including moving the restroom further from the street. Staff considered several aliernatives to bring the project back into`the approved budget. Moving the building further from the street addsan estimated $15,000 to $20,000 to the installation contract, however, the local re sidents''adamantly requested the change and therefore staff is not recommending a further.redesign. The pre-engineered, manufactured restroom building was reviewed, however the design is already at a bare bones level and therefore'staff does not recommend downsizing the current selected model. Staff recommends an increase in•the amount of Park Land Impact Fees used for the project by $40,000 and an increase in'the'totafproject budget to $140,000. WHEREAS, City staff has,prepared construction bid documents and advertised for construction of this Project and WHEREAS,in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code'Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS;,the-PiojectWwas bid on February 12, 2014, and eleven (11) bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for the Project was from Cats-4 U, Inc. for $73,950; and WHEREAS,,staffhasdetermined that Cats 4 U, Inc.'sbid+satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Cats 4 U, Inc. possesses.a;valid California Contractor's License, Class'A,,number 465781 that qualifies Cats 4 U, Inc. to perform the Project; and WHEREAS, the Project.has a Categorical Exemptionpursuant to the California Environmental Quality Act (-"CEQA"),.pursuant to Article 19, Section 15303, of Title 14 of the California Code of Regulations("CEQA Guidelines"). NOW, THEREFORE,'BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Approves the Project.BudgeVin1the amount of$140,000 including a contingency of $10,000, and - 2. Authorizes the transfer of funds from Parks Land Development Impact Fee Funds up to $120;000 into•the Wiseman Park Restroom CIP Project.account,,and 2. Inraccordancerwith=the City of Petaluma Charter and Municipal Code, California Public ContractCode:Section 20162 and other applicable law, waives any and all non- conformance in the bid:of Cats:4 U, Inc. for the Wiseman Park[Restroom Project, and finds the bid of$73,950 to be the;lowest responsive bid, and further finds that Cats 4 U, Inc. is the lowest responsible,bidder, and 3. Awards the contract for.the Wiseman Park-Restroom Project to Cats 4 U, Inc. in the amount of$73,950, conditioned:on:Cats 4 U, Inc:,timely executing;the project:contract and submitting all required documents, including-but not limited to, executed bonds, certificates of insurance,..and endorsements, in accordance with the project bid documents,and 4. Directs staff to issue a notice of award to Cats 4 U, Inc., and 4 • 5.
