Manager, Capital Improvements Division SUBJECT: Resolution Authorrizing,Application for a Sonoma County Agricultural Preservation and Open Space District 2014 Matching Grant Program for the Denman Reach Phase-3.Project, in the amount of$50,000. • RECOMMENDATION It is requested that the:City Council adept the attached resolution authorizing application for a Sonoma County Agricultural Preservation and Open Space District(SCAPOSD) 2014 Matching Grant Program for the Denman Reach Phase 3 Project; in the,amount of$50,000, and authorizing the City Manager to execute grant documents if a grant is awarded:. BACKGROUND • The Denman Reach Phase 3`projectwill complete the terracing and trail between Corona Road and the intersection of Industrial Avenue and Petaluma Boulevard North, There are five properties affected by the construction of Denman Reach Phase 3, three of which are the vacant parcelslocated on the west side=ofIndustrial Avenue•directlyacross from-the'intersection of • Benson Way and industrial Avenue. The;project requires the acquisition of two parcels in tee simple, a temporary constructionand trail easement over the third vacant parcel, and easements on the remaining two'developed_'parcels. In the falliof2008, the Citysubmitted two grant applications to the State of California for land ' acquisition and continuation of the flood terrace,.riparian habitat enhancement and trail improvements;within,the'Denman Reach. The first grant application was to the California Natural Resources Agency's (NRA) River Parkways Program,for land acquisition Mtheramount of$1,150,000, which was partially funded at $850;000. The second application was to the Department of Water Resources' (DWR) Urban Streams Restoration Program for $993,375 for design and construction, which was fully funded. Acquisition of the first parcel located at 1375 Industrial:Avenue, and-owned by Richards and Gilson was completed in September 2013 for $673,048. Following Council direction,to pursue additional.land acquisition funds,staff requested,additional funding which-resulted in NRA augmenting;its grant with an additional $165,262 bringing,the'NRA land.acquisitioncgrant top$1,015,262. Since-the original completion of the property appraisals in 2012,•themarket has'improved to the point of warrantinga second Agenda Review: City.Attorney Finance Director City.Managet (5 1 • appraisal on;the desired acquisitiomat 1335 Industrial„ownedby Gateway Financial and Coyne. The:appraisal',has been submittedto,the Stateddnding agency for approval with an estimate inarket`value for:the"Gateway Financial parcel at$370,000 The.requested authorization,-through the"SCAPOSD Matching Grant Program, will apply for the remaining $50;000;needed to•Complete the second acquisition. DISCUSSION The'NRA land acquisition grant currently contains approximately$335;000 uncommitted after the purchase of 1375 Industrial Way. Thelproperty owner of 1335 Industrial has indicated willingness to sell the;,parcel;at the new appraised value of$370;000. Therefore the additional grant,finds are neededto augmentthemvailable NRA funds to make the:purchase. The project has been found to be consistent,with CEQA through the adoption of a Mitigated Negative Declaration and project,approval on September 10, 2012 (Resolution No. 2012-138 N.C.S.). Staff recbmnendsthat Council authorizes the submittal of a grant;application to SCAPOSD for $50,000 to facilitate the land acquisition of 1335 Industrial for the Denman Reach Phase 3 project. • FINANCIAL.IMPACTS The land acquisition grant,,provided`by..the State Natural Resources Agency currently contains a balance of approximately $335;000, nottincluding final accounting of costs of grant administration. The approval of the SCAPOSD grant of$50,000 would"complete the funding needed to provide a market-value offer to the property ownermf 1335 Industrial. The proposed grant will require the City tomxpendfunds and then seek reimbursement. There are sufficient funds within.the Storm`Dram Impact.Fee account tobe utilized for purchasing the land subject to reimbursement upon'submittal for the grant payment. Staff will modify the CIP account for both the increase in funding and increase in land acquisition costs if the grant is approved. ATTACHMENTS • I. Resolution 2. 'Location Map 2 Attachment 1 RESOLUTION AUTHORIZINGsAPP.LICATION'TO THE SONOMA COUN,TYA°GRICULTURAL,PRESERVATION'AND.OPEN SPACE DISTRICT 2014 MATCHINGGRANTPROGRAM.FOR THE DENMAN REACH PHASE 3 PROJECT, IN THE AMOUNT OF $50,000, AND AUTHORIZING THE CITY MANAGER TO EXECUTE GRANT DOCUMENTS IF A GRANT IS AWARDED WHEREAS, the Sonoma County Agricultural Preservation and Open Space District California has announced the availability of funds,for the 2014 Matching Grant,Program; and WHEREAS, said grants are intended to provide open space preservation, community recreation, and public access opportunities; and WHEREAS, the Denman Reach•Phase 3Project will continue the.development of public open space, pathwaysand enhanced riparian corridor habitat along the'Petaluma River begun in the City's Denman Reach Phases 1 and 2 projects,which have been completed in cooperation with the Southern Sonoma County Resource Conservation District and.the Sonoma County Water Agency; and WHEREAS, the City of Petaluma has adopted the General Plan 2025 and the River Access and Enhancement Plan which call for the,acquisition of public open space lands and implementation of improvements as included in the project-proposed for funding with the grant funds, and recognize that as planned the project would be expected to be environmentally beneficial; and WHEREAS, the'Cityof Petaluma-has••complied with all applicable laws and regulations relating to the project, including if applicable,=requirements of the California Environmental Quality Act ("CEQA") and the National Environmental, Quality Act ("NEPA") with the adoption of a Mitigated Negative Declaration in September 2012, and a Finding of No Significant Impact (FONSI) for the Denman Reach Phase 3 Flood Iimpact.Reduction, Restorationand Enhancement Project in October 2012. 3 NOW,THEREFORE, BE IT`RESOLVED°that the City Council authorize filing of anapplication for. $50,000`with the Sonoma County Agricultural Preservation and Open Space District for the 2014 Matching Grant Program for the Denman Reach Phase 3 open space land acquisition project.
