Resolution No. 2003-029 N.C.S.
of the City of Petaluma, California
APPROVING AN AMENDMENT
TO THE GENERAL PLAN LAND USE MAP
FOR THE MAGNOLIA PLACE PROJECT
1120 MAGNOLIA AVENUE (APN 048-141-012) &
1111 GOSSAGE AVENUE (APN 048-132-027)
WHEREAS, an application was filed by Mission Valley Properties for amendments to
the General Plan Land Use Map to redesignate the approximately 6.31 acre development area
and the 2.21 acres of private open space on the Magnolia Avenue site from Public Park to Urban
Standard and to redesignate the approximately 7.37 acre Gossage Avenue site from Suburban
Residential to Urban Standard to allow development of a 45 unit residential subdivision, which
includes the dedication of approximately 8.74 acres of parkland to the City of Petaluma; and,
WHEREAS, the Planning Commission held a duly noticed Public Hearing;;on April 9,
2002, and considered all written and verbal communication on these matters before rendering
their recommendation for denial to the City Council; and,
WHEREAS, all reports and recommendations to the Planning Commission were
forwarded to the City Council; and,
WHEREAS, the City Council held a duly noticed Public Hearing to consider this
amendment on February Sand February 24, 2003, and considered all written and verbal
communications before rendering its decision; and,
WHEREAS, the potential environmental impacts of the project were considered and
proper action has been taken by the City Council in compliance with the California Environmental
Quality Act and local environmental guidelines.

NOW, THIEREFORE, BE IT RESOLVED that the Petaluma City Council hereby
approves the requested amendments to the General. Plan Land Use Map to change the
designations as outlined above based upon the following findings:
1. That the proposed amendment is deemed to be in the public interest.
The Amendment to the General Plan map will allow the City to obtain additional
parkland at no cost to the City as well as provide additional housing. A park is vitally
needed in the neighborhood. The City does not have the necessary funds to acquire or
maintain the parkland. The developer is also offering a maintenance annuity. The
Gossage Avenue site currently contains a chicken ranch that is not compatible with
the adjacent residential uses. The land proposed for development is within the City's
Urban Limit Line and Sphere of Influence and was slated for development. The
proposed drainage system will handle not only increased drainage from the proposed
development, but will handle a portion of the current drainage and storm water flows
during peak flows as well. Improvements to Magnolia Avenue will increase safety for
pedestrians.
2. That the proposed General Plan amendment is consistent and compatible with the rest
of the General Plan and any implementation programs that maybe affected.
The General Plan Amendment furthers a number of objectives, policies and goals of
the General Plan, which are listed in the Initial Study. The development will be within
the Urban Limit Line and Sphere of Influence, be harmonious with its setting and
enhance the City's image; improve the appearance, function and safety of Magnolia
Avenue; provide additional parkland to help the City meet its adopted minimum
standards; assist in providing a range of housing, types, including higher-value
housing; and improve drainage in the area.
3. That the potential impacts of the proposed amendment have been assessed and have
been determined not to be detrimental to the public health, safety, or welfare.

An Initial Study of Environmental Significance was completed and it was determined
that the project, with the incorporation of mitigation measures, will reduce potential
impacts to less than significant. In addition, the provision of a new neighborhood
park, street and drainage improvements will be beneficial to the public health, safety
and welfare.
4. That the proposed amendment has been processed in accordance with the applicable
provisions of the California Government Code and the California Environmental
Quality Act.
The applicant provided an Environmental Impact Questionnaire and numerous
environmental studies with the application. An Initial Study of potential
environmental impacts was prepared and referred to all responsible agencies and
agencies with jurisdiction over natural resources affected by the project held in trust
by the State. A Notice of Intent to adopt a Mitigated Negative Declaration, which
delineated the review period, was published in a newspaper of general circulation, as
well as sent to all residents and property owners within 500 feet of the proposed
development. The potential for the significant impacts to geology and soils, air,
hydrology and water, noise, visual quality and aesthetics, biological resources and
cultural resources were identified. Mitigation measures were proposed and agreed to
by the applicant that will reduce potential impacts to less than significant.
