HomeMy WebLinkAboutStaff Report 3.E 4/7/2014DATE: April 7, 2014 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan St. (oh , Director, Public Works & Utilities Larry Zimmer, P.E. — Capital Projects Manager SUBJECT: Resolution Authorizing Award of Contract for the Left -Tum Protective/Permissive Traffic Signal Modification Project RECOMMENDATION Staff recornmends that the City Council approve the attached resolution authorizing the award of contract for the Left -Turn Protective/Permissive Traffic Signal Modification Project and Authorizing the City Manager to Execute the Necessary Project Documents. BACKGROUND On March 1, 2010, City Council Adopted Resolution No. 2010-031 N.C.S. accepting the Cycle 3 Federal Highway Safety Improvement Program Grant for the Protected Left -Turn Signal Upgrade Project. A Traffic Safety Evaluation Report for the City of Petaluma was completed by the Institute of Transportation Studies at University of California Berkeley in collaboration with the City of Petaluma Police Department to evaluate the protected/permissive left -turn signal operations. The study was initiated because right-of-way collisions surpassed speed collisions as the highest cause of collisions in Petaluma. Right-of-way collisions are defined as those accidents that do not related to speeding but are caused when a driver neglects to yield the right- of-way to another vehicle. An example would be a driver who pulls out in front of on -coming traffic to make a left turn. This is significant because excess speeds in most jurisdictions are the highest cause of collisions. There are 26 protected/permissive left -turn signal intersections within the City of Petaluma. These intersections operate as follows: the protected green arrow turns to a regular green light termed a permissive left turn after a specified duration. The danger is that a driver can assume that there is no on -coming traffic once the permissive green light illuminates and can make a bad last-minute decision to pull out and attempt to turn left. This can cause an accident if on -coming traffic is present. In an effort to reduce these types of collisions, the subject project will upgrade 23 of the 26 intersections by replacing the protected/permissive signal housing with a protected left -turn only and flashing yellow arrow signals. Three additional intersections located at Rainer at N. Agenda Review: City Attorney Finance Director City Manager McDowell; Ellis/Johnson at E. Washington; and Stony Point at Old Redwood Highway, will be upgraded by private development or the State Department of Transportation (Caltrans) in the near future. Caltrans and the Federal Highway Administration (FHWA) have approved the flashing yellow arrow signal technology. With this technology, the left turn portion of the signal will begin as the customary green left pointing arrow for a set duration. The next phase will move to a solid yellow arrow to keep additional cars from initiating a left tum movement. The solid yellow arrow is followed by a red solid arrow of sufficient duration to clear the intersection of cars turning left. Following the solid red and after the intersection is clear of left turning vehicles, the signal will begin a flashing yellow arrow to permit drivers to make a left turn when on -coming conditions are clear. The Police Department will lead the public outreach program regarding the new signal type. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits." DISCUSSION The Notice Inviting Bids was issued on January 30, 2014. On February 26, 2014, 4 bids were received as follows: Name of Bidder Business Location Total Bid DC Electric Group, Inc. Cotati $267,423 W. Bradley Electric, Inc. Vallejo $386,577 Engineers Estimate $330,000 The lowest responsible bidder, DC Electric Group, Inc., has performed similar projects for the City of Petaluma. Staff verified that Contractor possesses a valid C-10 California Contractor's License, license number 949934, which expires on October 31, 2015, which qualifies Contractor to perform the work. , In light of the low bid amount, City staff investigated the possibility of upgrading all signal head lenses at the 23 intersections from 8" to 12" LED lenses to meet current traffic signal standards as well as to maximize the 90% safety grant funding. An estimate of $51,984 was submitted by the Contractor to complete this work and then provided to Caltrans for review and authorization to proceed. Caltrans has given the City an initial verbal authorization to proceed and will follow up in writing before the City moves forward. Once authorized, the additional work will be included as Contract Change Order No. 1. The funding for the change order will be added to the estimated construction contingency. The change order and contingency increase will not require additional local match contributions based on the currently approved budget. Construction is tentatively scheduled to begin in April of 2014 and to be completed by June of 2014. It is anticipated that inspection and construction management will be conducted by City staff. Engineering services during construction will be performed by the traffic engineering design consultant, W -trans. Location Map Attachment 1 RESOLUTION AUTHORIZING THE AWARD OF CONTRACT FOR THE LEFT -TURN PROTECTIVE/PERMISSIVE TRAFFIC SIGNAL MODIFICATION PROJECT AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY PROJECT DOCUMENTS WHEREAS, city staff has prepared construction bid documents and advertised for construction this project; and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on February 12, 2014, and four (4) bids were received and opened in accordance with applicable law; and WHEREAS, the lowest responsive bid for the Project was submitted by DC Electric Group, Inc. ("DC Electric") from Cotati, California for $267,423; and WHEREAS, staff has determined that the Contractor's bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that DC Electric possesses a valid California Contractor's License, Class C-10, number 949934 that qualifies DC Electric to perform the Project; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15301 (c), because the project consists of minor alteration modifications of existing highways and streets, sidewalks, gutters, and similar facilities, involving negligible or no expansion of use beyond that previously existing. WHEREAS, the funds made available are in the 2013/2014 CIP budget; and NOW, THEREFORE, BE 1T RESOLVED that the City Council of the City hereby: Approves a construction contract contingency of $73,155, and In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non- conformance in the bid of Contractor for the Left -Turn Protective/Permissive Traffic Signal Modification Project, Project No. 016101006, finds the bid of $267,243 to be the lowest, responsive bid and further finds that Contractor is the lowest responsible bidder, and 3. Awards the contract for the Left -Tum Protective/Permissive Traffic Signal Modification Project, Project No. C16101006 to Contractor in the amount of $267,423, the amount of 4 the lowest responsive bid, conditioned on DC Electric timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents, and 4. Directs staff to issue a notice of award to DC Electric, and Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Contractor of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
