SUBJECT: Adoption (Second Reading of an Ordinance Authorizing the City Manager to
Approve an Offer of Dedication to Pacific Gas and Electric Company for a Utility
Easement for the Purposes of Installing, Operating and Maintaining its Public
Utilities within the City Transit Facility at 555 North McDowell Boulevard, APN:
007-391-039 and within the City Well Site Parcel at 121 North McDowell
Boulevard, APN: 007-380-002.
RECOMMENDATION
It is recommended that the City Council adopt an ordinance authorizing the City Manager to
approve an offer of dedication to Pacific Gas and Electric Company (PG&E) for a utility
easement for the purposes of installing, operating and maintaining its public utilities within the
City transit facility at 555 North McDowell Boulevard, APN: 007-391-039 and within the City
well site parcel at 121 North McDowell Boulevard, APN: 007-380-002, as shown in the attached
Exhibit A.
BACKGROUND
The City previously approved the environmental impact report and design review for the Deer
Creek Plaza Shopping Center. As part of development of the site, PG&E utility lines have been
installed along the North McDowell street frontage of the City's Transit Facility property as well
as the Rainier Avenue and North McDowell Boulevard frontages of the City's well site parcel to
serve the Deer Creels Plaza project. The City Council unanimously approved the first reading of
the proposed ordinance at its March 17, 2014 meeting without any modifications.
By granting the easements, PG&E will obtain legal rights from the City to operate and maintain
its utility line infrastructure on the City's transit and well facility sites. In order for the City to
grant easements to another entity on property it owns, an ordinance must be approved by the City
Council. Granting of the easements and installation of the underground utilities will not
adversely affect the City's transit facility or well site properties and is required to activate service

to the project, including the new Friedman's site improvements. The posed easements will not
conflict with the existing or future alignment of Rainier Avenue.
FINANCIAL IMPACTS
This action has no impact on the City's budget. Funding for this project has been provided by the
developer of the Deer Creek Plaza Shopping Center, Merlone Geier Partners, on a cost recovery
basis for staff and legal time associated with this project.

AT 555 NORTH MCDOWELL BOULEVARD, APN: 007-391-039 AND WITHIN THE
CITY WELL SITE PARCEL AT 121 NORTH MCDOWELL BOULEVARD, APN: 007-
380-002.
WHEREAS, the City Engineer and City Attorney have reviewed the easement grant deeds and
legal descriptions noted as "Exhibit A" and have reported them to be in conformity with
applicable City standards and policies, the Subdivision Ordinance and Subdivision Map Act and
such reports have been forwarded to and reviewed by this Council.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
PETALUMA AS FOLLOWS:
1. That said grant of easements is hereby approved and shall be carried out; and,
2. The City Manager is hereby authorized and directed to sign the easement grant deeds
thereby offering the utility easements to Pacific Gas and Electric Company.
